Sending a question to the Hanoi Department of Health, Dr. Hong wondered if she would be entitled to professional preferential allowances according to Decree No. 56/2011/ND-CP?
Sharing about this issue, the Hanoi Department of Health said: Based on Decree No. 56/2011/ND-CP dated July 4, 2011 of the Government stipulating the professional preferential allowance regime for civil servants and public employees working at public health facilities; Joint Circular No. 02/2012/TTLT-BYT-BNV-BTC dated January 19, 2012 of the Ministry of Health, Ministry of Home Affairs, Ministry of Finance guiding the implementation of Decree No. 56/2011/ND-CP stipulating the subjects of application are "Civil servants and public employees".
According to the guidance in Official Dispatch No. 5845/BYT-TCCB dated July 29, 2016 of the Ministry of Health on implementing the professional preferential allowance regime, for contract workers who have not been recruited as public employees and have not been appointed to appropriate professional titles, they are not eligible for professional preferential allowances according to the provisions of Decree No. 56/2011/ND-CP and Joint Circular No. 02/2012/TTLT-BYT-BNV-BTC.
Thus, in the case of Ms. Nguyen Thi Hong, who is a contract doctor according to Decree No. 111/2022/ND-CP, she is not subject to the application of Decree No. 56/2011/ND-CP, so she is not entitled to professional preferential allowances according to Decree No. 56/2011/ND-CP.
However, in many public non-business units that self-ensure regular expenditures (group 2 self-financing) under the Department of Health currently, they pay contract workers support amounts according to the levels specified in Decree No. 56/2011/ND-CP using the unit's non-business revenue and must be specified in the internal spending regulations of the unit.
