According to Politico, the verdict with 6 votes in favor and 3 votes in favor was issued on May 6, 2025, restoring the effectiveness of the executive decree "Preferential excellence and readiness in the army" signed and issued by Mr. Trump.
The decree was issued just a week after Trump returned to the White House in January. Under the new regulation, individuals diagnosed with gender identity disorder will not be eligible to serve in the military, unless they accept biological gender service and do not seek gender reassignment.
The Supreme Court also overturned a previous national ban issued by a federal judge in Washington in March. This decision paves the way for the Ministry of National Defense to take necessary steps to screen and eliminate current soldiers with a history or symptoms related to gender identity disorder, and at the same time refuse to recruit new members of this group.
The new policy also requires a stop of all medical interventions such as transgender surgery and hormonal treatment for female soldiers on active duty. The Ministry of National Defense is directed to immediately implement the policy.
Mr. Trump first issued a ban on transgender people from joining the army in 2017. The policy was later overturned by former President Joe Biden in 2021. However, back in his second term, Trump restored the ban and made many changes to gender-related policies and the LGBTQ community.
Since returning to power, Trump has re downed dozens of decrees from his predecessors, including at least 12 decrees related to the rights of minorities and the LGBTQ community. He also issued an official decree recognizing only two sexes - male and female - and affirmed that gender is always present.
Another policy has also been introduced to end federal funding for measures he described as chemical transformation and surgery in adolescents, including produced contraindications, hormone therapy, and surgery for people under 19 years old.
