The Government has just issued Decree No. 93/2025/ND-CP amending and supplementing the inspection and disciplinary action in the enforcement of laws on handling administrative violations.
Decree No. 93/2025/ND-CP has 20 violations in the implementation of the law on handling administrative violations.
1. Detain the violation with signs of crime to handle administrative violations.
2. Forgery and falsification of records on administrative sanctions and records applying administrative handling measures.
3. Taking advantage of position and power to harass, demand, and receive money and assets of violators; condoning, covering up, and limiting the rights of violators when handling administrative violations.
3. Illegal intervention in handling administrative violations.
5. Do not draw up a record of administrative violations when detecting administrative violations according to the law.
6. Recorded administrative violations not in accordance with authority, not in accordance with administrative violations, not in accordance with the right subjects of administrative violations.
7. Violating the deadline for making administrative violation records or violating the deadline for issuing decisions on administrative sanctions.
8. Not issuing a decision to sanction administrative violations, not applying administrative measures to violators according to legal regulations or not confiscating exhibits and means of administrative violations, not applying remedial measures according to the provisions of Clause 2, Article 65 of the Law on Handling of Administrative Violations.
9. Sanction administrative violations, apply remedial measures or apply administrative handling measures that are not in accordance with authority and procedures (except for cases considered for handling violations specified in Clauses 5, 7, 8 and 10 of this Article), not to the right subjects as prescribed by law or apply inappropriate or incomplete forms of punishment, levels of punishment, remedial measures for administrative violations or do not apply forms of punishment, remedial measures for administrative violations.
10. Determine the violation incorrectly when issuing a decision to sanction administrative violations, except in cases where the violation is considered for handling as prescribed in Clause 9 of this Article.
11. Extend the deadline for applying administrative handling measures.
12. Do not amend, supplement, cancel, or issue new decisions in handling administrative violations or do not promptly amend, supplement, cancel, or issue new decisions in handling administrative violations when detecting errors or violations.
13. Not monitoring, urging, inspecting, organizing the implementation of decisions on administrative sanctions, decisions on confiscation of exhibits and means of administrative violations, decisions on applying remedial measures according to regulations; not organizing the enforcement of decisions on administrative sanctions, decisions on applying remedial measures according to regulations.
14. Illegally using money from administrative sanctions.
15. Not providing or providing inaccurate, incomplete, or dishonest information or documents related to the content of the inspection of law enforcement work on handling administrative violations.
16. Opposing or obstructing those on duty to inspect, threatening or deterring those who provide information and documents to the inspection team, causing difficulties in inspecting law enforcement on handling administrative violations.
17. Illegal intervention in inspection of law enforcement on handling administrative violations.
18. Providing and disclosing information, documents, and records of the inspected subjects to organizations and individuals without authority or responsibility.
19. Failure to implement or failure to fully and accurately implement the conclusion of the inspection of law enforcement work on handling administrative violations.
20. Irresponsible in directing the implementation of the conclusion of the inspection of law enforcement work on handling administrative violations.
