The Government issued Decree No. 93/2025/ND-CP on April 26 amending and supplementing a number of articles of Decree No. 19/2020/ND-CP dated February 12, 2020 of the Government on inspection and disciplinary action in the enforcement of laws on handling administrative violations.
Decree No. 93/2025/ND-CP amending and supplementing Article 6 of Decree No. 19/2020/ND-CP stipulates the inspection authority as follows:
The Minister of Justice inspects the implementation of the law on handling administrative violations of ministries, ministerial-level agencies, People's Committees at all levels and management agencies with competent authority to handle administrative violations.
The Minister inspected the implementation of the law on handling administrative violations within the scope of management.
The Governor of the State Bank of Vietnam inspected the implementation of the law on handling administrative violations within the scope assigned to the implementation organization.
Chairmen of People's Committees at all levels inspect the implementation of the law on handling administrative violations within the management area, except for agencies organized according to the vertical system located in the area.
The Head of the Government backlog inspects the enforcement of the law on handling administrative violations by his subordinate agencies and units.
Heads of agencies and units under central agencies are organized according to the vertical system of managing competent authorities to handle administrative violations, including: People's Public Security; Border Guard; Coast Guard; Customs; Tax; Civil Judgment Enforcement Management Agency; State Treasury; State Bank; Organizing centralized statistics system; Vietnam Social Insurance and other agencies and units under central agencies are organized according to the vertical system according to the provisions of law to inspect the enforcement of law on handling administrative violations for their subordinate agencies and units.
For cases of complex nature, inter-sectoral nature, nationwide, the Minister of Justice reports to the Prime Minister for consideration and decision on the agency responsible for presiding over the inspection.
The inspection team was established to conduct the inspection according to the decision of the competent person. The authority to establish an inspection team is implemented as follows:
The Minister of Justice, Chairmen of People's Committees at all levels established interdisciplinary inspection teams and inspection teams on law enforcement on handling administrative violations.
The competent inspector specified in Clauses 2, 4 and 5, Article 6 of this Decree shall establish an inspection team for law enforcement on handling administrative violations under the scope and management of the province and an interdisciplinary inspection team under the direction of the Prime Minister specified in Clause 6, Article 6 of this Decree.
In addition, according to the provisions of Clause 2, Article 8 of Decree No. 19/2020/ND-CP, the inspection team must have 05 or more members, including the Head of the team, 01 Deputy Head of the team and members.
According to Decree No. 93/2025/ND-CP, the above regulation is amended: Members of the inspection team include: Head of the delegation, Deputy Head of the delegation (if necessary) and other members. Ingredients, the number of members of the inspection team is decided by the issuer to check the decision in accordance with the actual situation.
