The commune-level Military Command has legal status, seals, accounts and private headquarters.

On January 11, according to information from the Government Electronic Information Portal, the Ministry of Justice is appraising the Draft Resolution of the Government on the organization and operation of the Military Command (MARC) of communes, wards, and special zones.

Accordingly, implementing the policy of bringing army officers to participate in the Commune-level Military Command in Conclusion No. 228-KL/TW dated December 31, 2025 of the Politburo and the Secretariat on the situation and results of operation of the political system apparatus and local government at 2 levels; based on the provisions of the Law on Promulgation of Legal Documents in 2025 and Resolution No. 206/2025/QH15 dated June 24, 2025 of the National Assembly on the special mechanism for handling difficulties and obstacles caused by legal regulations, the Ministry of National Defense shall develop a Draft Report on the Government's Legal Resolution on the organization and operation of the Commune, Ward, and Special Zone Military Commands.

The draft Resolution is built to arrange the Commune-level Military Command in accordance with the political system, the national defense guidelines of the whole people, and the people's war.

Build a regular commune-level Military Command, with a balanced organizational structure, suitable for local authorities at 2 levels, as the core force in building the national defense posture of the entire people, the posture of people's war associated with the posture of people's security, meeting the requirements of the task of protecting the Fatherland in the new situation.

The draft Resolution includes 8 articles regulating the organization, operation, and policy regime of the Commune-level Military Command.

The content of the Resolution focuses on regulations on the organization, operation, regime, and policies of the Commune-level Military Command in the period before amendments, supplements, or new laws are promulgated that have regulations related to this agency.

In which, the commune-level Military Command is a local military agency directly under the Provincial Military Command, the Centrally-run city, the Hanoi Capital Command, and the Ho Chi Minh City Command; under the leadership, direction, and administration of the Party committees and local authorities of the same level.

The commune-level Military Command has legal status, seals, accounts, private headquarters and performs a number of tasks such as: Training, combat readiness; force building; building and operating defense areas; National defense and security education; logistics - technical work; application of information technology and digital transformation in the military and defense fields according to the provisions of law; receiving complaints and denunciations, preventing and combating corruption and handling and proposing handling of violations of discipline and law according to authority; performing other tasks according to the provisions of law, orders of superior commanders.

In the coming time, the Ministry of National Defense will receive appraisal opinions, carefully review, and complete the draft Resolution to submit to the Government for consideration and decision.
