The Ministry of Home Affairs has just issued Official Letter No. 7644/BNV-CCVC to the People's Committees of provinces and cities to guide the recruitment and salary arrangement of civil servants who are Commanders, Deputy Commanders, and Assistants to the Military Command at the commune level.
Pursuant to Law No. 98/2025/QH15 amending and supplementing a number of articles of 11 laws on military and defense, the Commander, Deputy Commander and Assistant to the Commune-level Military Command are civil servants.
While the competent authority has not issued separate documents to adjust the above positions, the Ministry of Home Affairs requests the People's Committees of provinces and cities to unify the implementation of some contents.
Firstly, the job positions of these positions will be implemented according to the orientation of the job position list guided by the Ministry of Home Affairs in Official Dispatch No. 7415/BNV-CCVC dated August 31, 2025.
Second, regarding recruitment, because these 3 job positions are civil servants, recruitment is carried out according to the provisions of the Law on Cadres and Civil Servants and Decree No. 170/2025/ND-CP, except in cases where they are cadres and civil servants.
The authority to appoint; standards on training level and tasks of the above positions are implemented according to the provisions of the Law on Militia and Self-Defense Forces (amended and supplemented in Law No. 98/2025/QH15), the Government's Decree and the Ministry of National Defense's instructions on the implementation of the Law on Militia and Self-Defense Forces.
The number of Deputy Commanders and Assistants of Commune-level Military Commands shall comply with the provisions of Clause 2, Article 5 of Decree No. 220/2025/ND-CP.
Accordingly, key commune-level administrative units in defense are arranged no more than 2 Deputy Commanders and 1 Assistant; commune-level administrative units not in key national defense units are arranged with 1 Deputy Commander and 1 Assistant.
Third, from July 1, 2025, when implementing the organization of local government at 2 levels and implementing new regulations of the Law on Cadres and Civil Servants; Law on Militia and Self-Defense Forces, the arrangement of Commander, Deputy Commander, and Assistant to the Commune-level Military Command (new) will be implemented in 3 groups:
In case the Commander of the Commune-level Military Command (old) is a commune-level civil servant, when considered and assigned to the position of Commander, Deputy Commander, and Assistant at the Commune-level Military Command (new), he/she can be converted to a civil servant if he/she meets the training standards according to regulations.
In case other cadres and civil servants are expected to be assigned to the positions of Commander, Deputy Commander, Assistant at the Commune-level Military Command (new), they do not have to carry out the recruitment and acceptance process for civil servants but must meet the training standards.
Cases that are not cadres or civil servants expected to be assigned to the positions of Commander, Deputy Commander, and Assistant at the Commune-level Military Command (new) must carry out the recruitment and acceptance process for civil servants.
