Mr. Nguyen Van Binh (character's name has been changed), currently a civil servant holding the position of Commander of the Commune-level Military Command (CHQS).
According to Mr. Binh, before being recruited as a Commander civil servant (November 2023), he had worked and paid compulsory social insurance (SI) when holding the position of Deputy Commander of the Commune-level Military Command from July 12, 2018 to November 2023, according to the recruitment decision of the Chairman of the District People's Committee. The total time of service and compulsory social insurance payment up to now is 7 years and 4 months.
He said that he had worked continuously and paid compulsory social insurance before being recruited as a civil servant. Therefore, he asked whether in his case, the time of compulsory social insurance payment can be accumulated as a basis for salary classification according to job position, based on Section 12, Article 1 of Decree 116/2024/ND-CP, or not?
According to Decree 220/2025/ND-CP, you would like to know when the working period from July 2018 to present, when holding the position of Deputy Commander of the Commune-level Military Command and paying compulsory social insurance, will it be counted for seniority allowance and when will it be counted?
Mr. Nguyen Van Binh hopes that the Ministry of Home Affairs will soon have instructions to apply uniformly and in accordance with regulations.

The Ministry of Home Affairs said that according to the provisions of Article 20 of Decree No. 170/2025/ND-CP, in cases where a person recruited as a civil servant as prescribed in this Decree has worked for a period of time in accordance with the provisions of law in accordance with the requirements of professional qualifications of the recruited job position, and has paid compulsory social insurance (if not continuous but has not received a one-time social insurance subsidy, it will be accumulated), and is assigned to work according to the correct expertise and profession previously held, that working period will be counted as the basis for salary classification in the civil servant rank corresponding to the recruited job position.
