The Law on Civil Status (amended) was passed by the 16th National Assembly at the First Session. The Law officially takes effect March 1, 2027.
According to the provisions of the Law, the State has synchronous policies and measures, creating favorable conditions for individuals to exercise their rights and obligations to register for civil status. The State ensures budget, facilities, investment in digital transformation, and development of information technology for civil status registration and management activities.
The State prioritizes human resource development, ensuring stable job positions, training, fostering, improving capacity, and having appropriate preferential treatment for people working in civil status registration to improve the professionalism, stability and quality of civil status registration and management.
The law also stipulates the exploitation of information in the Civil Status Database. In which, individuals are allowed to exploit their information in the Civil Status Database.
A competent state agency is allowed to exploit information in the Civil Status Database in accordance with the functions and tasks of that agency.
In cases not covered by the above regulations, when exploiting information in the Civil Status Database, the consent of an individual who is the subject of the exploited information must be obtained, unless otherwise provided by law.
In case of exploitation of information of minors, people with loss of civil act capacity, people with difficulties in perception and controlling behavior, the consent of the legal representative must be obtained.
In case of exploitation of information of a person declared missing or deceased, the consent of the spouse or minor child of that person must be obtained; in case these people are not present, the exploitation of information must be obtained with the consent of the father or mother of the person declared missing or deceased.
People who have lost civil act capacity, people who have difficulty in perception and controlling their actions, and people who are not yet 15 years old exploit their information through legal representatives.
The exploitation of information in the Civil Status Database must ensure the protection of personal data in accordance with the law on personal data protection.
The Law also stipulates that agencies managing the Civil Status Database, civil status registration agencies, and civil status management agencies, within the scope of their functions and tasks, have responsibilities such as: Ensuring the safety of equipment for collecting, storing, transmitting, processing, and exchanging civil status information.
Or protect personal data, civil status information security on computer networks; ensure information security stored in databases; prevent and combat acts of illegal access and use, damaging the Civil Status Database.
