On behalf of the Politburo, Politburo Member, Standing Secretary of the Secretariat Tran Cam Tu signed and promulgated Regulation 212-QD/TW on disciplinary action against Party organizations and violating Party members.
Regulation No. 212-QD/TW stipulates the content of violations and forms of disciplinary action against Party organizations and Party members who violate to the extent that disciplinary action must be taken. Regulations apply to Party organizations (including Party organizations that have expired their term of operation, have been dissolved, ended operations, changed due to transfer, separation, merger, consolidation) and Party members (including Party members who are declared missing, Party members who have passed away but have particularly serious violations, Party members abroad).
In case party organizations and party members violate the content not stated in this Regulation, they shall be based on the Charter and policies, regulations of the Party, laws of the State, Charters and regulations of the Fatherland Front, socio-political organizations to handle discipline in accordance with this Regulation.
The Politburo's regulations clearly state that all Party organizations and Party members are equal before Party discipline. Party organizations and Party members who violate the Party's guidelines and regulations, and the State's laws must be considered for fair, accurate, and timely disciplinary action.
Disciplinary action must be associated with strengthening education and management, making party organizations and party members aware of shortcomings and violations to overcome, correct and do better.
Disciplinary action must be in accordance with principles, procedures, and authority, according to Party regulations; proactive, timely, public, democratic, objective, impartial, cautious, strict, accurate, and strict. When considering disciplinary action, it must be based on the content, motive, nature, severity, consequences, causes of violations, specific circumstances, aggravating or mitigating circumstances, awareness, attitude of self-criticism, acceptance of criticism and the results of correcting and overcoming shortcomings, violations, and consequences caused.
A violation is only disciplined once by one form of discipline. When discipline is considered at the same time, if there are two or more violations, consider and conclude each violation and make a general decision by the highest form of discipline; do not separate each violation to enforce different forms of discipline and multiple disciplinary actions.
According to Regulation 212-QD/TW, Party organizations disciplined, Party organizations where party members disciplined have been transferred, separated, merged, consolidated or terminated their activities, the announcement of disciplinary decisions shall be carried out at Party organizations that have received the transfer, separation, merger, consolidation or directly superior Party organizations of that Party organization.
Party organization discipline must clearly consider the responsibility of the organization, and at the same time consider the responsibility of each related individual to consider disciplinary action against violating party members, especially the responsibility of the head of the Party organization.
Party members in the Party organization who are disciplined must be responsible for the content of violations, the form of discipline of that Party organization and must be recorded in the Party member's resume; Party members who are not disciplined personally are still considered and implemented personnel work by the competent Party organization according to regulations. Party members who do not agree or are not directly related to the Party organization's violations must also be clearly recorded in the Party member's resume.
