The Ministry of Public Security is seeking opinions on the Draft Decree on administrative sanctions for violations in the field of fire prevention, fire fighting and rescue (PCCC&CNCH) (replacing Decree 144/2021).
According to the Ministry of Public Security (the drafting agency), in the period from 2013 to 2024, the Fire Prevention and Rescue Police force has recorded and handled 269,090 violations with a total fine of over 1,079 billion VND.
Of which, in 3 years (2022-2024), the authorities have handled over 112,700 violations with a total fine of more than 512 billion VND.
From 2022 to 2024, there were nearly 10,800 fires nationwide, killing 356 people and injuring 284 people, causing preliminary damage to about VND2,169 billion in money, of which the number of cases occurring in urban areas accounted for nearly 74%.
The Ministry of Public Security stated that the average income of people from 2015 to 2024 has increased sharply, from 2,109 USD/person to 4,700 USD/person, but the penalty for violations in the field of fire prevention and fighting has remained almost unchanged.
The sanctions in Decree 144 are no longer suitable for the development of society, and do not have enough deterrence and prevention of violations of the law on fire prevention and fighting and rescue.
Therefore, in the draft Decree, the Ministry of Public Security proposed to increase the fine for some acts to 20 times compared to Decree 144/2021/ND-CP, with some acts subject to maximum fines according to the provisions of the Law on Handling of Administrative Violations.
The violations are proposed to increase the fine of the use of fire and heat sources; Violation of equipment, installation, use and maintenance of FPF and Fire Prevention and Fighting Equipment established and maintained the Fire Prevention and Fighting Team of the grassroots level, the Fire Prevention and Fighting Team of specialized industry; acts related to spreading fire and escape; Acts related to self -checking fire protection ...
Notably, the Ministry of Public Security proposed a fine of 4-6 million VND for failure to maintain internal regulations, signs, prohibition signs, and warning signs on fire prevention and fighting and search and rescue that have been posted. Fine from 6-8 million VND for failure to issue or not posting PCCC & CNCH internal regulations.
The act of using fire sources, heat sources, equipment, fire-ghosting tools, and heat generation without ensuring a safe distance to prevent fire will be subject to a fine of 5-10 million VND. The act of installing or using electrical wires, electrical equipment, turned off equipment, and fire protection that does not ensure fire safety will be subject to a fine of 6-8 million VND.
Fine 40-50 million VND for one of the following acts: No fire prevention solution for the electrical charging area for electric motor vehicles concentrated in the house; no electrical system for fire prevention and fighting; no fire prevention solution for the electrical charging area for electric motor vehicles concentrated in the house.
The act of not installing a grounding and lightning protection system for houses and works is proposed to be fined from 20-25 million VND.
In addition, the draft clearly states the maximum fine for fire prevention and fighting and rescue for individuals is up to 50 million VND. For organizations with the same violation, the fine is twice the fine for individuals.
