Ministry of Home Affairs talks about civil servants' concurrent allowances

Ministry of Home Affairs provides information on concurrent allowances in cases where civil servants are assigned additional work while on maternity leave.

Mr. Pham Thanh Duc (Vinh Long) works at a type II commune-level unit (21 people) and has been assigned 21/21. However, there is 1 case of a civil servant on maternity leave.

"So in this case, is the unit allowed to allow other cadres and civil servants to hold concurrent positions according to Article 20 of Decree No. 33/2023/ND-CP?" - Mr. Duc wondered.

Regarding the reflection and recommendation of Mr. Pham Thanh Duc, the Ministry of Home Affairs said: Article 20 of Decree No. 33/2023/ND-CP of the Government stipulates that commune-level cadres and civil servants who concurrently hold positions or titles of commune-level cadres and civil servants other than the positions or titles currently held, and reduce the number of commune-level cadres and civil servants assigned by the district-level People's Committee according to regulations, shall be entitled to concurrent allowance.

In case of being assigned to take on additional work of a civil servant on maternity leave, it does not fall under the provisions of Article 20 of Decree No. 33/2023/ND-CP mentioned above, so the concurrent allowance is not entitled.

Accordingly, the Ministry of Home Affairs requested the Department of Home Affairs of Vinh Long province to coordinate with the Department of Finance and the Provincial People's Committee to have a support policy for this case.
