Mr. Nguyen Van Nam (character's name has been changed) learned about Decree 150/2025/ND-CP, which stipulates that departments are specialized agencies under the People's Committee at the commune level, but did not see any mention of the legal status of these departments.
"So let me ask, do specialized departments under the People's Committees at the commune level have legal status or not, and are engraved with seals or not? If there is no such thing, administrative procedures from the district level to the commune level according to the two-level government model will be very difficult to handle for the people" - Mr. Nam shared.
Regarding Mr. Nam's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
Implementing the conclusions of the Politburo and the Secretariat on the arrangement and reorganization of administrative units at all levels and building a model of organizing local government at two levels (provincial and commune levels); at the same time, implementing Resolution No. 74/NQ-CP dated April 7, 2025 of the Government on the Plan to implement the arrangement of administrative units and build a model of organizing local government at two levels, the Ministry of Home Affairs has submitted to the Government to issue Decree No. 150/2025/ND-CP dated June 12, 2025.
This Decree stipulates the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the People's Committees of communes, wards and special zones under provinces and centrally run cities. However, at the time of promulgation, Decree 150/2025/ND-CP did not stipulate that specialized agencies under the People's Committee at the commune level are allowed to use seals.
According to current Government regulations on decentralization, delegation of authority, and division of authority in implementing the two-level local government organization model, specialized agencies under the People's Committee at the commune level are assigned many tasks and powers in advising and organizing the enforcement of specialized and field laws.
Therefore, to ensure a legal basis for specialized agencies under the People's Committees at the commune level to officially operate from July 1, 2025, the Ministry of Home Affairs has submitted to the Government to issue a Resolution regulating the seals of specialized agencies under the People's Committees at the commune level.
According to the Ministry of Home Affairs, this is specified in Submission No. 4231/TTr-BNV dated June 24, 2025, as a basis for localities to implement in accordance with regulations.
