On the morning of June 24, the National Assembly voted to pass the Law amending and supplementing a number of articles of the Law on Organization of People's Procuracies (VKSND).
The results of the electronic vote showed that 409/412 delegates present voted in favor, accounting for 85.56%.
This Law takes effect from July 1, 2025.
Before voting, Mr. Nguyen Huy Tien - Director of the Supreme People's Procuracy reported on the reception and explanation of the opinions of National Assembly deputies on the draft Law amending and supplementing a number of articles of the Law on Organization of People's Procuracy.
Accordingly, the Draft Law amends and supplements regulations related to standards and conditions for appointing prosecutor's positions and the term of the prosecutor in the direction of not taking a promotion exam, only taking a one-time exam to the rank of primary prosecutor or intermediate prosecutor or senior prosecutor, then if eligible, being considered for appointment to a higher position.
"This amendment is to ensure compliance with the innovation of civil servant ranks according to the draft Law on Cadres and Civil Servants (amended); at the same time, ensure consistency with the regulations on appointment of judges - similar judicial titles" - Mr. Tien said.
Regarding amending the authority to decide on the total payroll of the People's Procuracy, it is to comply with Regulation No. 70-QD/TW, dated July 18, 2022 of the Politburo on payroll management of the political system. The above amended contents are also consistent with the Conclusion of the National Assembly Standing Committee on the draft Law in Notice No. 1345/TB-VPQH dated April 28, 2025 of the National Assembly Office.
The law also stipulates the increase of the maximum number of People's Procuracy Prosecutors from 19 to a maximum of 27.
In the explanation report, Mr. Tien said that this is to ensure human resources to carry out the task of prosecuting and supervising the trial for the activities of the Supreme People's Court's Judicial Council.
In addition, the Supreme People's Procuracy has received the opinions of the National Assembly Standing Committee and the National Assembly's Standing Committee on Justice and Law, amending and supplementing Article 28 of the current Law on the Organization of the People's Procuracy on the duties and powers of the People's Procuracy when supervising the enforcement of civil judgments and administrative judgments to ensure compliance with the arrangement and streamlining of the apparatus of civil judgment enforcement agencies;
Amend Article 42 of the current Law on the Organization of the People's Procuracy in the direction of adding specific regulations on the names of the Prosecution and Appellate Procuracy's institutions under the organizational structure of the Supreme People's Procuracy to ensure and synchronize with Clause 6, Article 1 of the draft Law amending and supplementing a number of articles of the Criminal Procedure Code and Clause 4, Article 3 of the draft Law amending and supplementing a number of articles of the Law on the Organization of People's Courts...
