On the afternoon of June 26, the National Assembly discussed in the hall the draft Law on Transferring People serving Imprisonment sentences.
Delegate To Van Tam ( Kon Tum Delegation) said that the draft law stipulates the cost of transferring people serving prison sentences according to the provisions of the law on the State budget.
According to the delegate, the provisions as in the draft Law ensure flexibility, unity, and synchronization with the legal system on the State budget, in accordance with the use of management and settlement of funds from the State budget according to general regulations.
Agreeing with the draft Law opening the possibility for other organizations and individuals to voluntarily contribute to support part or all of the costs, the delegate suggested clarifying how to assign the Ministry of Public Security to manage and use this funding source?
Delegate Do Ngoc Thinh (Khanh Hoa Delegation) commented that the draft Law has raised almost all issues related to receiving people serving prison sentences abroad to Vietnam and transferring people serving prison sentences in Vietnam to foreign countries.
However, the delegate said that the draft Law still has many legal provisions assigned to the Government to specify in detail the implementation instructions. The delegate suggested that the Drafting Committee should immediately add these contents to the draft Law.

Speaking to explain and clarify the opinions of the delegates, General Luong Tam Quang - Politburo member, Minister of Public Security - said that regarding funding, the draft Law stipulates that those serving prison sentences or agencies or organizations and individuals can voluntarily contribute.
In which, it can support all or part of the travel expenses and other expenses of people serving prison sentences transferred according to the provisions of law.
The voluntary contribution amount is only used to pay individuals serving prison sentences who are transferred from the country to the country to receive it.
According to Minister Luong Tam Quang, implementing the innovative viewpoint in law-making, the draft Law only stipulates very general things and the Government will specify this content in detail.
Regarding the conversion of prison sentences, this issue was stipulated in Article 58 of the 2007 Law on Judicial Assistance, but only sets out general principles that are difficult to implement in practice.
Article 23 of the draft Law has inherited and supplemented more specific regulations on the principle of converting penalties to ensure more feasibility. Along with that, criminal law in the world is very diverse and diverse, so it is not feasible to specify this issue in detail in the draft Law.
In response to the opinions of the delegates, the Government and the drafting agency will study and revise in the direction of regulations for the Minister of Public Security, the Chief Justice of the Supreme People's Court, and the Chief Prosecutor of the Supreme People's Procuracy to guide this content.
General Luong Tam Quang stated that regarding the opinions of National Assembly deputies at the group and hall, the Government will closely coordinate with the National Assembly's functional agencies to seriously study and absorb them to revise and complete the draft Law to ensure the requirements set out to submit to the National Assembly for approval at the 10th Session.
