On the morning of May 24, the National Assembly discussed in the hall the draft Law on Personal Data Protection.
Speaking to clarify some issues of concern to delegates, General Luong Tam Quang - Politburo member, Minister of Public Security - said that promulgating the law soon is very necessary. 150 countries in the world have issued laws on personal data protection.
In the context of extensive digital transformation, the Minister said that most socio-economic activities are shifted on cyberspace. Personal data associated with each person should demonstrate their rights to privacy... so they will face an increased risk of vulnerability.
The law must also be predictive and comprehensive to regulate new issues related to breakthrough technology in the digital age to protect personal data most comprehensively.
From the practical work of combating personal data violations, the Government has submitted to the National Assembly a draft law regulating prohibited acts related to personal data. The issues that the delegates were interested in and had many different opinions were the regulation prohibiting the purchase and sale of personal data.
According to the Minister, the awareness of personal data protection of many organizations, businesses and individuals is currently limited. The importance of protecting personal data is also not fully understood, creating gray areas in the use of personal data.
Personal data with characteristics associated with humanity, personal rights, and privacy. Therefore, personal data cannot be considered ordinary goods and assets but a special resource.
Therefore, the exploitation and use requirements must go hand in hand with the highest level of protection. Allowing the sale of personal data is the act of allowing the sale of human rights and the right to decide on the information of others.
In fact, large-scale fraud and property appropriation cases have been busted, but the factor of leaking and trading personal data is the main cause of criminals committing crimes.
"Buy and sell personal data such as goods with a large amount of data, sell many times to many subjects to analyze, exploit, build fraud scenarios and approach victims accurately and easily", the Minister emphasized.
According to the Minister, many organizations currently lack regulations, inadequate management policies, and decentralization of personal data processing. This leads employees to get customer information with very high accuracy, updated in real time to sell to scammers, especially in the fields of finance, banking, telecommunications, electricity, insurance, delivery, etc.
From the above evidence, the Minister said that if there is no regulation on the ban on the purchase and sale of personal data as common goods and there are strict sanctions, many methods and tricks will appear in practice to form a black market for personal data. This will cause consequences, great damage and insecurity for the people.
The draft law also adds and amends to regulate leasing and personal data borrowing activities to commit illegal acts. In which, prohibiting the use of personal data of others, allowing others to use their personal data to commit illegal acts.
The scope of regulation of the law has been adjusted in both traditional and electronic environments. In reality, data during the collection and processing process can continuously change state between traditional and electronic, if only regulated in the electronic environment, it will create legal gaps and loopholes for criminals to take advantage of to violate personal data.
