On the morning of September 4, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Management and Use of Weapons, Explosives and Supporting Tools, the Law on Fire Prevention and Fighting (PCCC) and Rescue and Relief (CNCH).
Presenting the report, Senior Lieutenant General Le Van Tuyen - Member of the Party Central Committee, Deputy Minister of Public Security said that the development of the Law amending and supplementing a number of articles of the Law aims to promote decentralization, cut down, and simplify administrative procedures and business conditions.
At the same time, creating a transparent and open business investment environment, reducing compliance costs for people and businesses.
Regarding the basic content of the draft Law amending and supplementing the Law on Fire Prevention and Fighting, CNCH. The draft amendment removes the regulation on inspection of fire prevention and fighting acceptance and implementation of post-inspection work combined with fire prevention and fighting safety inspection after works and vehicles are put into operation and use.
Appraising the draft Law, Member of the Party Central Committee, Chairman of the National Defense and Security Committee Le Tan Toi said that the Standing Committee agreed on the necessity of promulgating the law with the reasons mentioned in the Government's Submission.
Regarding the amendment and supplementation of a number of articles of the Fire Prevention and Fighting and Rescue Law, the Standing Committee basically agreed with the provisions in Article 2 of the draft law that have amended and supplemented 12 articles of the current law in order to reduce and simplify administrative procedures.
However, it is proposed to clearly stipulate the responsibilities of heads of establishments, household heads, and vehicle owners in complying with the contents of design appraisal, promulgation on fire prevention and fighting, and maintaining fire prevention and fighting requirements for works and vehicles that have been put into use compared to the applied technical standards and regulations.
It is proposed to supplement regulations clearly defining the legal responsibilities of investors, project owners, vehicle owners and the capacity standards of independent consulting and acceptance units to avoid risks arising, unsafety, and fire and explosion.
Speaking to contribute opinions afterwards, Member of the Party Central Committee, Vice Chairman of the National Assembly Nguyen Thi Thanh also proposed that the Government carefully review the regulations on abolishing procedures for inspecting fire prevention and fighting acceptance and switching to post-inspection.
When transferring responsibility to the investor, the post-inspection mechanism must be clear enough and capable of operating in practice" - the Vice Chairman said and emphasized that this change does not mean ignoring management, but replacing it with another management mechanism that is more effective and more convenient for society, and is not at all relying on the role of the State.
It is proposed that the draft law manage according to the level of risk, classify works according to fire and explosion risks, and apply data to focus resources on inspection in high-risk areas.
At the meeting, Member of the Party Central Committee, Chairman of the Committee for Culture and Social Affairs Nguyen Dac Vinh also raised his opinion on the transition from pre-inspection to post-inspection for projects in fire prevention and fighting.
Mr. Nguyen Dac Vinh wondered about the group of apartment buildings with many residents, high-rise apartment buildings need to ensure absolute safety, because if they are built and repaired, it will be very difficult.
According to the Chairman of the Committee for Culture and Social Affairs, it is possible to stipulate a number of particularly important groups of projects to maintain control regulations in both design and acceptance stages.
