Ho Chi Minh City will cut off electricity and water from illegally built works, violating fire prevention

Ho Chi Minh City - Illegal, wrongly licensed constructions, violations of fire prevention and fighting or land encroachment in Ho Chi Minh City will have their electricity and water supply stopped.

The Ho Chi Minh City Department of Construction is organizing to collect opinions on the draft Resolution of the Ho Chi Minh City People's Council stipulating the application of measures requiring the cessation of electricity and water service provision for works, production and business establishments in the city.

According to the draft, the request to stop the supply of electricity and water will be applied in 7 cases.

First, construction works that violate planning; construction without a permit for cases where a permit is mandatory; construction that violates the content of the permit or the approved design for cases exempted from permits. This measure is only applied when the competent authority has requested to terminate the violation, stop construction but organizations and individuals still do not comply.

Second, the project is built on encroached and occupied land according to the provisions of land law and has been requested to terminate the violation or stop construction in writing but still intentionally continues.

Third, the project is subject to appraisal or design appraisal for fire prevention and fighting but still constructs when it has not been granted a certificate or appraisal document by a competent authority according to regulations; even though construction has been requested to stop, it still does not comply.

Fourth, the construction project is not in accordance with the fire prevention and fighting design that has been appraised or evaluated and does not implement the request to stop construction of functional agencies.

Fifth, establishments providing dance clubs and karaoke services that do not ensure fire prevention and fighting safety conditions, falling into cases where operations have been suspended but still operate or do not implement the rectification requirements of competent authorities.

Sixth, production, business establishments or construction works that violate environmental protection regulations but do not comply with the decision to suspend operations, request to stop violations or remedial measures.

Seventh, the project is subject to demolition and there has been an urgent relocation decision from a competent authority, but organizations and individuals still do not implement it after being mobilized and persuaded.

According to the Department of Construction, after merging with Binh Duong and Ba Ria - Vung Tau, Ho Chi Minh City has an area of about 6,796 km2 and a population of more than 14 million people, the largest in the country.

The rapid urbanization process has led to a large demand for housing, works and production and business facilities, leading to many violations in the fields of land, construction order, and fire prevention and fighting.

Common violations include construction against planning, unlicensed or illegal construction, construction against approved designs, land encroachment, violations of regulations on fire prevention and fighting approval... These acts cause many difficulties for state management.

The Department of Construction said that although functional agencies regularly inspect and handle, many investors still intentionally continue construction after being recorded or requested to stop.

One of the reasons is that the awareness of law compliance of a part of organizations and individuals is still limited, while current sanctions, especially remedial measures such as forced demolition of works, restoration of the status quo or completion of procedures for fire prevention and fighting, are not enough to deter.
