Contributing opinions to the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH), the Department of Home Affairs of Can Tho City proposed to amend and supplement Clause 5, Article 17 as follows: "Specialized inspection of the implementation of laws on compulsory social insurance, voluntary social insurance, the implementation of medical examination and treatment contracts for health insurance (BHYT), management and use of health insurance funds; the contribution and payment of unemployment insurance (BHTN), health insurance. Specialized inspection of social insurance, unemployment insurance, health insurance contributions".
Explaining the above proposal, this Department said that inspection work plays a key role in ensuring the correct implementation of health insurance policies, protecting the rights of participants and using the fund effectively.
Since 2006, the task of inspecting the health insurance fund has been assigned and implemented continuously, and by 2024 it will continue to be legalized in the Law on Social Insurance.
Reality shows that this activity has been effective, recovering many incorrect expenditures, contributing to improving discipline and order.
However, current law only stipulates inspection for medical examination and treatment facilities, not covering the health insurance payment of agencies, organizations and within the social insurance system, leading to gaps in expenditure control.
Therefore, the Department of Home Affairs of Can Tho City believes that it is necessary to maintain and clarify the regulations on health insurance payment inspection of social insurance agencies to ensure practical suitability, improve the efficiency of fund management and ensure fairness and transparency in policy implementation.
Responding to this content, the Ministry of Home Affairs said that the Draft Law has stipulated the rights of social insurance agencies in specialized inspection of social insurance contributions.
According to the Summary Report and proposal to amend and supplement the Law on Social Insurance (BHXH) No. 41/2024 of the Department of Home Affairs of Can Tho City, as of April 30, 2026, the whole city is currently managing the payment of monthly pensions and social insurance allowances for 43,067 people, with an average monthly payment of about 330.8 billion VND.
In 2025, the City Social Insurance has conducted a total of 30 inspections at 71 units. In addition, the City Social Insurance participated in coordinating with the City Department of Home Affairs to conduct inter-sectoral inspections at 7 labor-using units. In addition, the City Social Insurance has conducted 6 surprise inspections at 9 labor-using units.
Through this, about 8.35 billion VND has been recovered from late payment of social insurance, health insurance, and unemployment insurance (reaching 100% compared to the late payment amount of about 8.35 billion VND); recovered 248 million VND (reaching 100% compared to the amount to be recovered of 248 million VND); recovered 102 million VND to the social insurance fund (reaching 41.8% compared to the amount to be recovered of 244 million VND).
At the first thematic session "Implementation of policies and laws on social insurance (BHXH) in the period 2021 - 2026" of the Supervisory Delegation of the National Assembly Standing Committee, Deputy General Director of Vietnam Social Security Chu Manh Sinh said that supervision and surveys need to be carried out at all types of enterprises.
The problem of debt arrears, late payment and evasion of social insurance payments occurs most often in the private enterprise sector," he said and said that this directly affects the rights of workers, making it difficult to resolve regimes. He requested the Delegation to conduct a deep survey to come up with effective solutions to overcome them.
