Contributing opinions to the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH), the Department of Home Affairs of Can Tho City proposed amending and supplementing Clause 12, Article 141 of the Law on Social Insurance as follows: For the amount of compulsory social insurance, unemployment insurance, occupational accident insurance, occupational disease insurance that employers are responsible for paying according to the provisions of Law No. 58/2014/QH13, Employment Law No. 38/2013/QH13, Law on Occupational Safety and Health No. 84/2015/QH13 but by the end of June 30, 2025, if they do not pay or do not pay fully, they will be handled according to the provisions on late payment and evasion of payment of this Law.
Explaining the above proposal, the Department of Home Affairs of Can Tho City said that the law on social insurance, unemployment insurance, and health insurance has uniformly and synchronously stipulated measures to handle late payment and evasion of payment, including forcing full repayment of the amount and paying interest 0.03%/day on the amount and time of violation.
However, the Law on Occupational Safety and Health stipulates a different interest calculation mechanism for occupational accident and disease insurance, leading to inconsistency in the legal system. This difference causes difficulties for the social insurance agency in the process of application and organization of implementation.
Responding to this proposal, the Ministry of Home Affairs said that this content is currently being implemented according to the provisions of the Law on Occupational Safety and Health.
Regarding strengthening management efficiency in the field of insurance and social security, Dr. Pham Ngoc Toan - Director of the Center for Analysis, Strategic Forecasting and Public Services (Ministry of Home Affairs) said: The Ministry of Home Affairs and ministries and sectors are promoting digital transformation, building specialized databases and strengthening data connection and intercommunication between agencies.
According to Mr. Toan, the Department of Home Affairs is completing databases on workers, labor demand, labor fluctuations, labor markets and data from job exchanges.
When these systems are connected to data from social insurance agencies, tax authorities and other management agencies, the capacity to monitor, inspect and compare information will be significantly improved.
The formation of an interconnected data system not only helps to detect early cases of enjoying wrong regimes but also effectively supports management, planning and policy implementation. Many control stages will now be implemented automatically instead of relying on manual procedures," he emphasized.
Mr. Toan cited an example, when the data is integrated, units such as the Employment Service Center will no longer take much time to review and compare dossiers with the social insurance agency. Most of the information can be verified directly from the system, only some special cases need additional inspection.
According to him, with the digital transformation roadmap being implemented by the Government and the participation of ministries and sectors in building specialized databases, Vietnam will soon form a synchronous inter-sectoral data system, contributing to improving the efficiency of state management and minimizing fraud and policy profiteering.
