The draft Law on Supervisory Activities of the National Assembly and People's Councils (amended) will be voted for by the 15th National Assembly at the 10th Session.
The draft Law has been comprehensively amended to continue to improve the effectiveness and efficiency of the supervision activities of the National Assembly and People's Councils (HDND).
Vice Chairman of the National Assembly Tran Quang Phuong assigned the Standing Committee of the Petition and Urgent Supervision Committee to preside over the coordination of the receiving agencies and report to the National Assembly Standing Committee, before the National Assembly fully approves the draft Law, in the spirit of ensuring that no opinions are not received or explained, creating the highest consensus.
In fact, recently, the supervision activities of National Assembly deputies (NADs) have been mainly through the supervision activities of theNADs. In particular, the questioning is one of the independent supervision activities that shows the best results of the National Assembly Delegation.
Other contents in the independent supervision activities of the National Assembly deputies are very limited or may not be able to organize the implementation of the supervision program, such as: supervision of legal documents, supervision of law enforcement in localities, supervision of the settlement of complaints and denunciations against citizens' recommendations, etc.
From the above issues, delegate Mai Van Hai (Thanh Hoa National Assembly delegation) suggested that it is necessary to review and re-regulate the authority and supervision activities of National Assembly deputies as questioning and supervision through the organization of activities of the National Assembly Delegation.
Delegate Le Thanh Hoan (Thanh Hoa National Assembly Delegation) commented on the responsibility of receiving citizens, receiving and handling complaints and recommendations from citizens.
Article 28 of the Law on the Organization of the National Assembly stipulates: National Assembly deputies are responsible for receiving citizens according to the provisions of law. When receiving complaints, denunciations, and recommendations from citizens, National Assembly deputies are responsible for studying, promptly forwarding them to competent authorities for settlement, and notifying those who complain, denounce, and recommend; urging, monitoring, and supervising the settlement.
The person with the authority to resolve the issue must notify the National Assembly members of the results of resolving complaints, denunciations and recommendations of citizens within the time limit prescribed by law.
Article 54 of the current Law on Supervisory Activities also does not clearly stipulate the deadline for competent authorities to respond to National Assembly deputies, but only stipulates within the time limit prescribed by law.
Meanwhile, with the transfer of petitions from the National Assembly Standing Committee, the Ethnic Council, and the Committees being 7 days from the date of issuance of the settlement decision, it is also difficult to exercise this authority.
Because if the agencies have resolved the complaint and denunciation, do they need to reconsider the petition sent by the National Assembly agency or only respond that it has been resolved.
Therefore, delegate Le Thanh Hoan proposed to continue to regulate the responsibility of National Assembly deputies in receiving citizens, receiving and handling complaints and recommendations from citizens and needs to stipulate a specific deadline for competent authorities to resolve complaints and denunciations to have a written response to National Assembly deputies.
In some other cases related to the process and procedures of judicial proceedings, when the judicial agencies need to answer or just answer in general, they are considering and resolving them according to the proceedings, there should be specific regulations.
