The 8th session of the 15th National Assembly will open on October 21, 2024 to consider 39 contents, including the draft Law on Fire Prevention, Fire Fighting and Rescue (PCCC&CNCH).
According to Article 7 of the draft law, fire prevention and fighting and search and rescue are the responsibility of agencies, organizations, households and individuals operating and living in the territory of Vietnam.
Citizens aged 18 years or older and in good health are responsible for participating in the grassroots fire prevention and rescue team, specialized fire prevention and rescue team or civil defense team when required.
The head of the facility, except the head of the household, is responsible for organizing propaganda, dissemination, education of knowledge, laws, training and coaching on fire prevention and fighting and search and rescue within the scope of management.
At the same time, establish and maintain the operation of a grassroots Fire Prevention and Rescue Team or a specialized Fire Prevention and Rescue Team or assign people to perform Fire Prevention and Rescue tasks within the scope of management according to the provisions of law.
The head of the facility must issue regulations, rules, and measures for fire prevention and fighting and search and rescue, organize implementation, inspect, urge, and supervise agencies, organizations, and individuals in the facility under their management regarding the implementation of regulations, rules, and maintaining conditions to ensure fire prevention and fighting and search and rescue safety.
In addition, develop and organize fire fighting drills; equip and maintain the functionality of fire prevention and fighting and rescue equipment; organize fire fighting, rescue, and overcome consequences caused by fires, accidents, and incidents;
In addition, establish and manage records on fire prevention and fighting and search and rescue within the scope of management; declare and update the database on fire prevention and fighting; perform other tasks on fire prevention and fighting and search and rescue according to the provisions of law.
The head of the facility that rents, lends, or allows people to stay at houses is responsible for disseminating, urging, and reminding people who rent, borrow, or allow people to stay at houses to comply with the provisions of the law on fire prevention and fighting and search and rescue.
The person renting, borrowing, or staying at a house has the responsibilities as prescribed in Clause 6 of this Article (the responsibilities of the head of the household directly using the house), unless otherwise agreed with the person renting, borrowing, or staying at the house.
Housing must ensure fire safety conditions such as installing and using electrical equipment to ensure safety according to regulations; arranging cooking stoves, places of worship, and burning votive paper to ensure safety; keeping flammable and explosive objects and substances away from fire and heat sources.
Housing must ensure conditions for fire fighting and escape, such as having fire prevention and fighting equipment suitable to the actual capacity and conditions to be ready for fire fighting and escape; arranging and maintaining paths to ensure escape or escape routes, emergency exits.
For housing types with technical regulations and standards cited in technical regulations and legal documents, implementation shall comply with the provisions of those technical regulations and standards.
The State encourages households to install fire alarm devices and connect them to the fire alarm communication system. The Fire Prevention and Rescue Police Force is responsible for providing guidance on connecting fire alarm devices to the fire alarm communication system when required.
