The Government Office has just issued Notice No. 344/TB-VPCP concluding of Member of the Party Central Committee, Deputy Prime Minister Le Tien Chau at a meeting on the draft Law on Asset Auction (amended).
In the announcement, the Deputy Prime Minister assigned the Ministry of Justice to preside over and coordinate with relevant ministries and agencies to receive reasonable opinions at the meeting, urgently complete the draft law dossier, and report to the Government before July 10.
The Deputy Prime Minister reminded the Ministry of Justice to review and fully supplement the types of assets that the law stipulates must be sold through auctions, especially new types of assets formed in the digital economy, assets that are exploitation rights, toll collection rights, and service fee collection rights in the exploitation and use of BOT projects and projects invested by the State.
At the same time, there are overarching regulations to ensure full data on the types of assets that the law stipulates must be auctioned in the future (if any).
Regarding the online auction of assets on the online asset auction system, on June 26, 2026, the Government issued Resolution No. 66. 21/2026/NQ-CP on promulgating specific mechanisms and policies to remove difficulties and obstacles in the implementation of online asset auctions according to the provisions of the Law on Auction of Assets.
This Resolution stipulates specific mechanisms and policies on online property auctions, therefore, in the process of implementing the Resolution, the Ministry of Justice needs to closely coordinate with the Ministry of Public Security to both do and assess the effectiveness and feasibility of the policy to promptly complete the regulations in the draft Law from now until the Law is passed by the National Assembly.
Regarding the establishment and organization of assets auction enterprises, the Ministry of Justice shall study, absorb, and reasonably explain the opinions of relevant ministries and agencies; propose options for selection; supplement the content of explanation and impact of the option for selection to report and seek opinions from Government members.
Regarding a number of regulations to improve the efficiency of handling public assets, preventing and preventing manipulation of auction results, the Deputy Prime Minister requested the Ministry of Justice to review and evaluate to appropriately regulate the deposit rate in land use rights auctions to allocate residential land to individuals (most opinions at the meeting proposed adjusting from 10% to 50% to 20% to 50% in Article 29 of the draft law).
Government leaders also agreed with the regulation on determining adjacent auction winners in Clause 3, Article 37 of the draft Law, however, this regulation should only be applied in cases of auctioning assets that are required by law to be auctioned.
Regarding the development of auctions of assets of individuals and organizations voluntarily choosing to sell through auctions, the Deputy Prime Minister requested to review and improve regulations to promote the development of voluntary auctions, on the basis of ensuring flexibility in implementation, low compliance costs, respect for the right to decide of owners, protecting bona fide buyers, information transparency and quickly resolving disputes (if any).
