The Ministry of National Defense is seeking opinions on the second draft of the Circular on policies and regimes when reorganizing and streamlining the apparatus in the Army.
Article 8 of the draft Circular states the conditions and calculation of policies for cases that are not old enough to be re-elected or reappointed; meet the age requirement for re-election, reappointment or are participating in Party committees at all levels of the Party Committee that must end their activities but wish to retire early.
Accordingly, the conditions for enjoying policies and regimes are:
Officers, professional soldiers, defense officials, and people working in key positions under the Government backlog receive salaries as for soldiers specified in Clause 1 and Clause 4, Article 2 of this Circular holding positions and titles under the structure of participating in the Party Committee, full-time members of the Inspection Committee at the same level but not meeting the age requirements for re-election or reappointment to the new term.
Subjects at Point a of this Clause are eligible for the re -election age and re -appointment of the new term to have the time of work from the beginning of the meeting to organize the Congress from the full 30 months to 60 months; In special cases, from 12 months to less than 30 months, the expiry of the highest service age or to the retirement age under the guidance in Clause 5, Article 5 of this Circular but because of the arrangement of personnel of the Party Committee, it is the desire to retire and be agreed by the competent authority.
Subjects specified in Clauses 1, 2, 4 and 5 Article 2 of this Circular are participating in the Party Committee at the Party Committee (5 -year term) to end the activity, consolidate the organization of the apparatus to 5 years (60 months) or less, the expiry of the highest service age or to the retirement age at the instructions at Point a, Point b, Clause 5, Article 5 of this Circular, have the aspiration to retire before the National Party Congress to create conditions The XIV of the Party and agreed by the competent authority.
Regarding the calculation of policy benefits, according to the draft Circular, the subjects specified in Clause 1 of this Article who are eligible for early retirement are entitled to the benefits specified in Clause 8, Article 1 of Decree No. 67/2025/ND-CP.
In which: The subsidy regime for the number of years of early retirement and the subsidy regime according to the working period with compulsory social insurance contributions are implemented according to the instructions in Point b, Point c, Clause 1 and Clause 3, Article 6 of this Circular.
One-time pension benefits for the number of months of early retirement are implemented as follows:
One-time pension allowance = Current monthly salary according to the instructions in Clause 3, Article 4 of this Circular x 1.0 x Number of months of early retirement according to the instructions in Clause 1, Article 5 of this Circular.
