Continuing the program of the 9th session, on the morning of May 14, the National Assembly discussed in the hall on the draft resolution of the National Assembly amending and supplementing a number of articles of the 2013 Constitution (the first time); The Law on the Local Government Law (amended).
At the end of the discussion session, the Minister of Home Affairs spoke to explain and clarify a number of issues raised by National Assembly deputies regarding the draft Law on Organization of Local Government (amended).
According to the draft, the Law on Organization of Local Government (amended) will take effect from July 1, 2025.
The implementation of the two-level local government model will strongly impact the organization and operation of the local state apparatus, contributing to promoting administrative reform, building a modern, effective, efficient and better serving the people.
One of the notable contents of the draft Law is to amend regulations on promoting decentralization and delegation of power and clearly defining the tasks and powers of local governments at the provincial and commune levels.
In which, the Chairman of the Commune People's Committee has 16 tasks and powers stipulated in Article 23 of the draft Law.
Notably, one of the tasks and powers of the Chairman of the Commune People's Committee proposed by the Government: "Directing and taking responsibility in the recruitment and use of civil servants and officials in the area in accordance with the law and decentralization of superior state agencies.
Decision to appoint, dismiss, transfer, and remove from the position of head or deputy head of another professional agency or administrative organization or public service unit under the People's Committee at his/her level; decision to temporarily suspend the work of the Vice Chairman of the People's Committee at his/her level, the head of another professional agency or administrative organization, or public service unit under the People's Committee at his/her level".
Organize the local government apparatus: Commune-level People's Councils are organized into 2 Committees: Legal Committee and Socio-Economic Committee.
Commune-level People's Committees are organized with specialized agencies suitable to the scale and characteristics of administrative units and can arrange specialized civil servants to handle specific fields. The number of provincial People's Council delegates will also be adjusted to suit the merger of administrative units.
The commune level has expanded its authority, allowing the issuance of legal documents within the scope of management of new areas and points compared to current regulations.
Contributing opinions to the draft Law on Organization of Local Government (amended), delegate Tran Anh Tuan (HCMC Delegation) suggested that the drafting committee of the draft law should inherit the quintessence and advantages of the old model in organizing local government.
The delegate suggested adding the role and responsibility of the head in organizing the local government apparatus, the responsibility of explaining to the people in the organization, and resolving cases more clearly.
In addition, it is necessary to improve public administrative services to organize local governments more effectively.
