On the afternoon of May 29, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Vietnamese nationality.
Delegate Do Thi Viet Ha (Bac Giang Delegation) suggested that it is necessary to specify more clearly the condition "can return to Vietnamese nationality".
The draft law stipulates that a person who has lost his/her Vietnamese nationality as prescribed in Article 26 of this law and has applied to return to Vietnamese nationality can return to Vietnamese nationality.
According to the delegate, the use of the phrase "may" leads to an emotional understanding; it is not consistent with the name "condition to return to Vietnamese nationality".
Therefore, the delegate proposed to consider and amend in the direction of specifically regulating the conditions for "may" return to Vietnamese nationality right in the law or amend in the direction of replacing the phrase "may" with the phrase "reviewed and decided".
The delegate suggested reviewing and ensuring consistency in documents proving Vietnamese nationality with relevant legal regulations.
Regarding documents proving Vietnamese nationality, Clause 2, Article 1 of the draft Law amending and supplementing Clause 2, Article 11 of the Law on nationality stipulates: " c identification card, citizen identification card, identification card, electronic identification card". Accordingly, the documents are the People's Certificates as stipulated in the 2008 Law, and 3 additional types of ID cards are added.
However, according to Article 46 of the Law on Identification, it is necessary to prove that the people's documents are expired, so it is necessary to assess whether the regulation on keeping the same documents as the Law on Identification as the 2008 Law is appropriate or not to prove Vietnamese nationality?

Delegate Duong Khac Mai (Dak Nong Delegation) said that according to statistics from the Ministry of Public Security, there are still 31,117 people of unidentified Vietnamese origin living in Vietnam without documents, not being able to study, receive medical examination and treatment or enjoy social policies, most of whom are concentrated in the southern provinces.
The delegate also agreed with the regulation in Vietnam, the State only recognizes Vietnamese nationality for Vietnamese citizens with multiple nationality in relations with competent authorities in Vietnam.
According to the delegate, this is a very important basis for resolving legal conflicts when handling violations by people of many different backgrounds, including Vietnamese nationality, in Vietnam.
The delegate said that in the past, there have been many cases of people of many backgrounds taking advantage of foreign nationality to conceal or avoid criminal liability in Vietnam, especially in cases of money laundering, drug trafficking or fraud, high-tech crimes.
The delegate also noted that when expanding the conditions for naturalization and return to nationalhood, the number of people with multiple nationality participating in civil relations such as inheritance, real estate ownership, investment, etc. will increase.
From there, he recommended that the authorities should promptly assess and continue to assess the impact to build appropriate and reasonable mechanisms and policies to effectively manage problems that may arise in the future.

As a National Assembly delegate, I also want to send a message to those who have returned: Return with the spirit of love for the Fatherland and a noble civil responsibility to contribute to building Vietnam to develop more and more," the delegate emphasized.
