Supplementing and perfecting institutions
Institutional reform tasks are one of the important tasks in the Administrative Reform Plan of the Ministry of Home Affairs in 2025 recently issued with Decision No. 252/QD-BNV of the Minister of Home Affairs. In particular, emphasizing the task of focusing on reviewing, amending, supplementing, and perfecting institutions and policies, ensuring constitutionality, legality, synchronization, specificity, and feasibility.
The plan is promulgated in order to synchronously implement the contents, tasks and solutions to promote the administrative reform of the Ministry of the Interior, on the basis of closely following the overall program of state administrative reform in the period of 2021 - 2030, the Prime Minister's Directive on promoting the implementation of the overall program of state administrative reform in the period 2021 - 2030.
Minister Pham Thi Thanh Tra said that regarding institutional reform, the Ministry of Home Affairs focuses on reviewing, amending, supplementing and perfecting regulations and policies to ensure consistency, legality, synchronization, specificity and feasibility.
The focus is on improving the quality, ensuring the progress of developing, promulgating and organizing the implementation of legal documents under the management scope, related to the organization of the administrative apparatus, operating mechanisms, policies for cadres, civil servants, public employees, local authorities; labor, wages, social insurance and employment.
The Ministry of Home Affairs said that this agency determined to focus on reviewing, amending and supplementing policies related to the organizational structure, operating mechanisms, policies and policies for cadres, civil servants and public employees fully and synchronously to ensure the performance of performance goals, effectiveness and efficiency of the apparatus and improve the quality of cadres, civil servants and public employees after arranging and organizational structure.
Former Deputy Minister of Home Affairs Tran Anh Tuan commented that although the legal system has focused on building and perfecting, it is still complicated, unstable, low quality, and low life expectancy.
"Many overlapping and contradictory regulations often need to be amended and supplemented; creating many legal and policy risk traps, easily legalized during implementation" - Mr. Tuan said.
In addition, the mechanisms and policies in the slow-changing legal system have created a "sh full-fledged shirt" that gives rise to many specific policies for localities to develop. When too many characteristics have become no longer a characteristic...
The provisions of the law on organizational structure and public service regime, civil servants also have many bottlenecks and difficult to implement. This is most evident in the terms of terms, although the organizational structure in recent years has been arranged in a streamlined direction but still half -hearted, lack of synchronization, overall and comprehensive, still bulky, overlapping, many intermediate hiccups.
The root of institutional bottlenecks
The cause of the above bottlenecks, related to legal institutions, according to Mr. Tran Anh Tuan, is due to slow change in thinking and awareness in accordance with practical requirements.
Entering the new era, thinking must also "rise up", must change to build development theories in each industry, each field, especially the field of law-making. In particular, it is necessary to change and shift to market thinking, thinking to perfect the Socialist Republic's rule of law state.
To remove institutional bottlenecks, it is necessary to pay attention to building a civil service foundation, with the human factor, considering the human factor as the center and root.
According to Mr. Tran Anh Tuan, we have not been completely great with the thinking "the government can do everything", not fully aware of the role of the Government in the market economy, so that the design of the government's organizational structure is in accordance with the direction of "small government, big society"; "The government drives a boat without sailing." Therefore, it is necessary to design in the direction of the locality to allow the locality to decide, implement and take responsibility.
