This is the content mentioned in Decree No. 35/2026/ND-CP of the Government detailing a number of articles of the Resolution on urban classification.
Decree No. 35/2026/ND-CP stipulates the order and procedures for requesting the recognition of type I urban areas.
The Provincial People's Committee (UBND) assigns specialized agencies under the province to organize the development of a project to recognize type I urban areas; in case of hiring a consulting unit, it shall be implemented according to the provisions of law on bidding.
The agency or consulting unit assigned to develop a project to recognize urban type shall organize surveys and develop a project according to regulations. In case the project maker is not the Department of Construction, it is necessary to have a document accompanying the project explanation sent to the Department of Construction for appraisal.
Within a maximum of 5 working days from the date of receiving the project and the document from the project-making unit, the Department of Construction is responsible for reviewing, inspecting, and preliminarily evaluating the project's explanatory notes, and sending them for comments from the Provincial Police, the Provincial Military Command, and professional departments and branches under the province.
The document sent for opinion collection must clearly state the content to be consulted according to the functions and tasks of the consulted agency; in case the Department of Construction prepares a project, the Department of Construction is responsible for sending opinions to the agencies specified in this section.
Within a maximum of 5 working days from the date of receiving the written opinion request from the Department of Construction, the opinions requested agencies are responsible for sending written comments to the Department of Construction for verification.
Within a maximum of 10 working days from the date of receiving the written comments, the Department of Construction appraises the project or completes the project if it directly prepares the project.
In case the consulting unit prepares a project, the Department of Construction sends a notice of the appraisal results to the consulting unit for completion, the notice must clearly specify the completion time of the project and send it to the Department of Construction for consideration to report to the Provincial People's Committee.
The dossier of the Department of Construction sent to the Provincial People's Committee includes: Submission and appraisal report, project explanation and summary table of explanations, receiving comments.
After receiving the dossier submitted by the Department of Construction, the provincial-level People's Committee will consider and submit it to the People's Council (HPC) of the same level for approval of the project.
Within a maximum of 10 working days from the date of the resolution approving the project of the Provincial People's Council, the Provincial People's Committee shall send 1 set of dossiers to the Ministry of Construction for organization of appraisal and recognition of type I urban areas.
Within a maximum of 5 working days from the date of receiving the dossier, the Ministry of Construction shall issue a decision to establish an inter-sectoral appraisal council to organize project appraisal.
The time for the Appraisal Council to conduct appraisal and report to the Ministry of Construction is a maximum of 30 working days, from the date of issuing the decision to establish the Appraisal Council.
After appraisal, including cases where dossiers must be completed (if any), the standing agency of the Appraisal Council shall submit a report accompanying the dossier to the Ministry of Construction.
Within a maximum of 5 working days from the date of receiving the dossier, the Minister of Construction shall consider and issue a decision recognizing a type I urban area.
Within a maximum of 15 working days from the date of receiving the decision on urban type I recognition from the Ministry of Construction, the Provincial People's Committee shall organize the announcement of the decision on urban type recognition.
