The National Assembly Standing Committee has given opinions on the draft Law amending and supplementing a number of articles of the Customs Law.
The draft Law amending and supplementing a number of articles of the Customs Law has focused on amending and supplementing a number of regulations on customs procedures; risk management; post-customs clearance inspection; temporary suspension of customs procedures for goods showing signs of intellectual property rights infringement and some related contents.
In addition, the draft Law also amends and assigns the head of the customs agency where customs dossiers are handled to decide on the exemption from actual inspection of goods in other special cases.
At the same time, supplement transit goods to the group of goods transported subject to customs supervision as prescribed.
Notably, the draft supplements the authority for customs authorities to proactively suspend customs procedures if in the process of inspection, supervision, and control, there is a clear basis to suspect that transit goods are counterfeit goods in terms of intellectual property.
Along with that, abolishing the regulation "not applying temporary suspension of customs procedures for transit goods".
Regarding post-customs clearance inspection, the draft Law supplements the principle of post-customs clearance inspection on the basis of modernization and application of risk management; consolidating post-customs clearance inspection procedures at the headquarters of customs declarants and at the headquarters of enterprises.
The draft Law amends the post-customs clearance inspection period and extends the inspection time from "10 working days" to "maximum 20 days"; stipulates the principles for implementing post-customs clearance inspection and assigns the Government to detail this content.
The Standing Committee of the Law and Justice Committee and the agencies of the National Assembly agreed and basically agreed with the scope of amendment of the draft Law.

Regarding regulations on customs inspection, it is necessary to continue to review and improve them in the direction of clarifying the content, technical criteria, bases, methods and scope of inspection; and at the same time clearly distinguish them from conformity assessment activities according to the provisions of specialized laws.
