The draft revised Capital Law will be discussed, considered, and approved by the National Assembly at the first session of the 16th National Assembly taking place in early April.
This Law stipulates the position and role of the Capital; mechanisms, policies, authority, responsibility for building, developing and protecting the Capital. The draft Law is assessed as having many new and outstanding policies, strongly delegating power to the city government.
According to the draft law, the City People's Council (HĐND) decides and promulgates regulations on the proportion of full-time HĐND delegates; the number, functions, tasks and powers of the Boards of the City People's Council and the Commune-level People's Council; criteria for determining the number of Commune-level People's Council delegates;
At the same time, it is decided and promulgated regulations on the number and structure of members of the City People's Committee (UBND) and commune level; organization and operation of villages and residential groups; number, titles, title standards, regimes, and policies of non-specialized personnel in villages and residential groups in accordance with the level of urbanization and the actual conditions of socio-economic development of the City.
Number, establishment, reorganization, dissolution of specialized agencies, administrative organizations under the City People's Committee, commune-level People's Committee; decisions to change the name, adjust the functions of existing specialized agencies, administrative organizations;
Along with that, it is decided on the autonomy regime for public non-business units under the management of the City; income policies for cadres, civil servants, public employees and employees receiving salaries from the City budget.
At the same time, it is allowed to decide on the use of budget sources at all levels of the City and other legal financial sources to implement this policy; civil servant and public employee positions under the management scope of the City; regime of management and use of civil servants and public employees according to the principle that the person directly using civil servants and public employees performs recruitment and evaluation; pilot contract civil servant regime...
The draft Law also states that the City People's Committee has the authority to establish public non-business units according to the regulations of the City People's Council.
Regulations on policies and measures to organize the implementation of digital administration and digital public duties; regulations on mechanisms and measures to promote democracy at the grassroots level, mobilize the participation of people in local governance; contract work mechanisms and other mechanisms to promote the self-management role of villages and residential groups.
The draft revised Capital Law consists of 9 chapters, 36 articles, a reduction of 18 articles compared to the current law.
