This draft law has supplemented regulations prohibiting the adoption of children for people who have been sentenced to imprisonment but are given a suspended sentence; amending regulations prohibiting the adoption of children for people who have not been cleared of criminal records to people who have been convicted of one of the crimes of infringing upon the life, health, dignity, and honor of a person; incestuous crime; crime of seducing, coercing or harboring a criminal under 18 years old; drug crimes...
This regulation aims to ensure that adopted children live in a safe and healthy family environment.
In addition, the draft law also supplements regulations allowing social workers to participate in supporting the settlement of adoption and after settling adoption to improve the quality of adoption settlement work.
Social workers supporting the settlement of adoption according to the request of the competent authority deciding on adoption, including: civil servants, public employees, social workers; people working in child protection, cultural and social work at the commune level; other social workers as prescribed by law.
The draft Law also supplements regulations on termination of adoption for cases where the adopted child is a minor but both the adoptive father and mother die, lose civil act capacity, suffer from a serious illness or have to serve a prison sentence.
The addition of this regulation is to ensure the interests of adopted children in cases where both adoptive parents do not have conditions to care for and raise them, or letting children live with adoptive parents will not ensure that adopted children live in a safe and healthy family environment.
Along with that, the draft Law supplements regulations that social assistance establishments are responsible for implementing the conversion of alternative care forms at social assistance establishments to adoption for children who need to be adopted.
This is to ensure that children live in a family environment, not allowing children to live concentrated for a long time, affecting the comprehensive development of children in terms of physical, intellectual, mental, moral and social relationships.
