Proposal to develop a Law on Prevention and Control of the Dissemination of Dilapidation of Arms

The Ministry of National Defense is proposing to develop a Law on Prevention and Control of the Propagation of Mass Destructive Weapons.

Accordingly, the Ministry of National Defense is proposing to develop a Law on Prevention and Control of the Dissemination of Mass Destructive Weapons to complete the legal framework and effectively implement international treaties related to the prevention and control of the dissemination of weapons of mass destruction to which Vietnam is a member.

The Ministry of National Defense said that weapons of mass destruction are weapons that can cause great losses to the enemy in terms of vitality, technical means, economic facilities, national defense, security, ecological environment and have a strong impact on human psychology and spirit.

Resolution No. 1540 dated April 28, 2004 of the United Nations Security Council ( adopted under Chapter VII of the United Nations Charter) requires United Nations member states to promulgate and implement appropriate laws to prohibit non-state entities from producing, obtaining, owning, developing, transporting, transferring or using nuclear, chemical or biological weapons and means of transporting and distributing weapons.

As an active and responsible member of the international community, Vietnam has been a member of many international treaties related to the prevention and combat of the proliferation of weapons of mass destruction.

Notably, Decree No. 81/2019/ND-CP dated November 11, 2019 of the Government on preventing and combating the proliferation of weapons of mass destruction is the first legal document to directly and fully regulate the prevention and combat of the proliferation of all four types of weapons: biological, chemical, nuclear and radioactive.

The Government's issuance of Decree No. 81/2019/ND-CP at the request of the Ministry of National Defense is a major effort of Vietnam to create a legal framework to effectively fulfill national obligations on preventing and combating the proliferation of weapons of mass destruction stipulated in international treaties to which Vietnam is a member and Resolution No. 1540 of the United Nations Security Council.

During the implementation of Decree No. 81/2019/ND-CP for the period 2019-2024, the Ministry of National Defense - National Unit Agency has advised the Government and guided ministries, branches and localities to carry out tasks in accordance with regulations and effectively.

Thereby, to raise awareness and knowledge of ministries, branches, localities and people on the work of preventing, combating and disseminating and sponsoring the dissemination of weapons of mass destruction.

Improve the effectiveness of State management, the capacity to prevent and respond to situations of preventing and combating the spread of weapons of mass destruction. To date, there have been no incidents related to the dissemination and sponsorship of weapons of mass destruction.

The Ministry of National Defense proposes to develop a Law on Prevention and Control of the spread of weapons of mass destruction with 5 policies:

Policy 1: Completing general regulations on prevention and control of the proliferation of weapons of mass destruction.

Policy 2: Improving the effectiveness of common prevention and control work for each type of weapons of mass destruction.

Policy 3: Strengthen the prevention and control of weapons of mass destruction through border control and control of dual-use goods.

Policy 4: Complete regulations on prevention and control of sponsorship of the dissemination of weapons of mass destruction.

Policy 5: Improve capacity and perfect the functions and tasks of State agencies in the work of preventing and combating the proliferation of weapons of mass destruction.
