On December 9, information from the General Department of Civil Judgment Enforcement said that the Interdisciplinary Inspection Team of the Ministry of Justice organized an inspection of the compliance with administrative procedural law and administrative judgment enforcement by the People's Committees and Chairmen of People's Committees at all levels in Binh Thuan province.
Attending the inspection sessions were Mr. Nguyen Van Luc - Deputy Director General of the General Department of Civil Judgment Enforcement (Ministry of Justice) and members of the Inspection Team representing agencies: Supreme People's Court; Supreme People's Procuracy; Government Office; Government Inspectorate, Department of Civil and Economic Law, Ministry of Justice.
Speaking at the inspection, Mr. Nguyen Van Luc stated that the work of complying with administrative procedural laws and enforcing administrative judgments has increasingly received attention from the leadership and direction of the National Assembly, the National Assembly Committees, the Government, the Prime Minister, and National Assembly deputies.
According to statistics on the results of annual administrative judgment enforcement, in 2024, Binh Thuan province is one of the localities with a large number of administrative judgments that have not been fully enforced.
Therefore, implementing the direction of the Prime Minister, the Ministry of Justice has issued a Decision to establish an interdisciplinary inspection team to assess the situation of compliance with administrative procedural law and the enforcement of administrative judgments by the People's Committees and Chairmen of People's Committees at all levels in Binh Thuan province, clarifying the results achieved, shortcomings, limitations, difficulties, problems and causes.
On that basis, propose and recommend to the People's Committee of Binh Thuan province and relevant agencies and units solutions to ensure strict compliance with the law on administrative proceedings and administrative judgment enforcement.
From the inspection results, the Inspection Team has made some initial recommendations and proposals to the Chairman of Binh Thuan Provincial People's Committee.
For unexecuted judgments, the Inspection Team requested the People's Committee of Binh Thuan province to report and put complicated administrative judgment enforcement cases in the locality under the leadership and direction of the Provincial Party Standing Committee.
Party committees and heads of People's Committees at all levels need to clearly define their roles and responsibilities for administrative judgment enforcement, thereby closely and resolutely directing the enforcement of administrative judgments.
Chairmen of People's Committees at all levels need to strictly and resolutely perform the two roles of being the person who must execute the judgment in the Court's judgments and being the head of the direct superior agency of the person who must execute the judgment in urging, directing, inspecting and strictly handling the responsibility of subordinates with authority who do not execute administrative judgments in accordance with regulations.
In case it is necessary to establish a working group to synthesize, review, evaluate, and make plans to advise on a definitive solution for each specific case.
