For businesses to owe insurance for decades, National Assembly delegates say there are shortcomings
On the afternoon of May 10, the National Assembly discussed in groups the draft Law amending and supplementing a number of articles of the Law on Enterprises.
Delegate Truong Trong Nghia (HCMC Delegation) was interested in the obligations of enterprises to employees. Recently, violations of social insurance and unemployment insurance for workers have been very serious. There are businesses that have owed social insurance for decades, hundreds of billions of VND.
This creates great frustration because workers have nothing in hand other than salary, while business owners have assets and production materials.
"That money is the money of workers, the enterprise must pay. Now taking that money back, not paying to the workers, greatly affects them", the delegate said.
Therefore, the delegate believes that the draft law must emphasize the regulation on compliance with the implementation of policies and regimes of social insurance, unemployment insurance, health insurance, etc. to be more strict. If there is no word "perpetrator" but only the word "implementation", businesses will have a reason to still implement but not fully.
Through legal research, the delegate believes that social insurance debts can be prosecuted. When insurance is owed, if that enterprise goes bankrupt, workers will lose everything and do not know who to ask for.
"Uncontrolled business, allowing businesses to accumulate debts for decades, up to hundreds of billions, and in some cases thousands of billions of VND is our weakness. Therefore, I propose to strengthen this obligation to businesses," said the delegate.
Regarding the regime for storing documents of enterprises, the delegate said that there is currently a digital transformation application in business registration. However, the regulation still keeps the registration of enterprises based on documents. When the inspection and examination agency comes to work, the paper documents will be questioned. The storage process will be damaged by termites, earthworms, floods, and fires.
Meanwhile, there are now digital tools and electronic tools that are guaranteed to be safe and can be stored in many different ways.
"Recently, businesses complained because there are many contracts signed electronically and via email, but when completing procedures, customs always require paper documents," the delegate said and suggested that there should be clear regulations for businesses to use digital and electronic forms in transactions and document storage.
This saves a lot for society and businesses, helping to handle procedures much faster.
Enterprises ask tenants to keep their names on the road

According to the delegate, it is necessary to fix the problem of going to the business registration address but there is no business there, when going to inspect and supervise, it is not possible to see the image of the business owner. Currently, there are many shortcomings in the process of business registration and post-inspection.
The draft Law amended, not continuing to stipulate the content of the establishment of the enterprise must submit a judicial record card to the business registration agency. Delegates said that at a discussion session in the 13th National Assembly, he requested to have a judicial record card because at that time the business asked the tenant in the name of the household, asking the motorbike driver in the name of the business household.
"There are cases where when cases have occurred, that person is serving a sentence but is still the business owner, still doing business. Therefore, the criminal record will solve that problem," said the delegate.
To reduce the burden of administrative procedures, the delegate proposed to replace the regulation that the business registration agency will coordinate with the management agency if necessary according to the provisions of the Law on Judicial Records by having to coordinate to ensure a cleaner business environment.
