The Government has just issued Decree No. 58/2026/ND-CP amending and supplementing a number of articles of decrees related to regulations on security and order conditions for a number of conditional investment and business lines; management and use of seals; management and use of firecrackers; detailing a number of articles and measures to implement the Law on Residence and the Law on Citizen Identification.
Article 3 of Decree 58/2026 amending and supplementing a number of articles of Decree No. 137/2020 regulating the management and use of firecrackers was amended and supplemented in 2023.
Amending and supplementing Clause 2, Article 10 of Decree No. 137/2020 as follows: "The Minister of Public Security decides that organizations and enterprises under the Ministry of Public Security are allowed to research, produce, export, import, and supply fireworks; The Minister of National Defense decides that organizations and enterprises under the Ministry of National Defense are allowed to research, produce, export, import, and supply fireworks".
Thus, in addition to the enterprises of the Ministry of National Defense as at present, organizations and enterprises under the Ministry of Public Security are allowed to research and produce fireworks.
The new Decree also clearly states that organizations and enterprises under the Ministry of Public Security and the Ministry of National Defense assigned by the Minister of Public Security and the Minister of National Defense to research, produce, import, export, and supply fireworks or enterprises under the Ministry of Public Security and the Ministry of National Defense with cargo transportation occupations, meeting the conditions for transporting industrial explosives, are allowed to transport fireworks and explosives.
Fireworks business is carried out by organizations and businesses under the Ministry of Public Security and the Ministry of National Defense and must be granted a Certificate of eligibility for security and order by a competent police agency; ensuring conditions on fire prevention and fighting, incident prevention and response, and environmental protection.
The Government also stipulates that organizations and businesses under the Ministry of Public Security and the Ministry of National Defense are allowed to research and produce fireworks and fireworks powder, then they are allowed to export and import fireworks and fireworks powder; only import fireworks products that are not yet produced domestically.
Also according to Decree 58, cases of organizing fireworks displays during Lunar New Year, Hung Kings Commemoration Day, National Day, Dien Bien Phu Victory Day, April 30th, anniversary of liberation day, and the founding day of provinces and cities will be decided by the Chairman of the Provincial People's Committee based on the actual situation of the locality.
This is also a new point when directly delegating authority to the head of the provincial government. Meanwhile, the organization of fireworks displays on the above occasions will be coordinated by the Provincial and City People's Committees with the Ministry of Culture, Sports and Tourism to organize and implement.
In addition, the case of organizing fireworks displays on the occasion of cultural, tourism, sports, national, international events and cases of changing the range and duration of fireworks displays will be decided by the Chairman of the Provincial People's Committee based on the proposal of the specialized cultural agency under the Provincial People's Committee. Currently, this is decided by the Prime Minister.
Decree 58 will take effect from March 15.
