Accordingly, the draft Circular specifically stipulates the leave regimes, the authority to resolve, register, manage, and suspend the leave regime for officers, professional soldiers in the army, workers, and defense officials. This Circular applies to the above subjects as well as relevant agencies, units, organizations and individuals.
Soldiers, workers and defense officials are entitled to the following leave: Daily leave outside of working hours; Weekly leave; Annual leave; Special leave; Holidays, Tet; Nursing leave; Retirement leave.
In addition to the prescribed leave, soldiers, workers and national defense officials are entitled to sick leave, maternity leave, occupational accidents, and occupational diseases according to the provisions of the law on social insurance and occupational safety and hygiene.
Regarding daily leave outside of working hours:
Military personnel, workers and national defense officials are given daily leave outside of working hours.
Commanders of regimental-level units and equivalent or higher shall issue Regulations on resolving the regime of daily leave outside of working hours, ensuring combat readiness, performing tasks; in accordance with the characteristics of the situation and tasks of the agency, unit, circumstances, and conditions of subjects under their management; ensuring safety when participating in traffic.
Weekly holiday:
Every week, soldiers, workers and defense officials have Saturdays and Sundays off.
When the unit performs training tasks, is ready to fight or due to the requirements of other tasks, commands the regiment and equivalent or more, based on the specific situation of the unit, organizes the implementation of a suitable weekly leave regime.
Holidays and Tet:
Every year, soldiers, workers and national defense officials are given holidays and Tet holidays according to the provisions of the Labor Code and the founding day of the Vietnam People's Army - National Defense Day (December 22).
For units performing training, combat readiness or due to task requirements, the leave of regime is issued by the regimental commander and equivalent or higher, based on the unit's task situation and performance accordingly.
Regarding the authority to resolve leave regimes:
The authority to resolve the leave regimes prescribed in Articles 4, 5, 6, 7, 8 and 9 is implemented as follows:
Regiment commanders, regimental Political Commissars and equivalent or higher shall resolve for soldiers, workers and defense officials under their authority;
Officers holding positions from the Regiment Commander, Political Commissar of the regiment and equivalent or higher are directly decided by the commander and Political Commissar of the higher level.
The authority to handle retirement preparation leave prescribed in Article 10 of this Circular is implemented as follows:
For officers, the Regulations on personnel work in the Vietnam People's Army of the Central Military Commission are followed.
For professional soldiers, workers and defense officials, it is necessary to comply with the regulations of the Minister of National Defense.
