On April 28, the National Assembly Standing Committee gave its opinion on the draft Law amending and supplementing a number of articles of the Law on Vietnamese nationality.
Presenting the Draft Law on amending and supplementing a number of articles of the Law on Vietnamese nationality, Minister of Justice Nguyen Hai Ninh said that the draft Law focuses on two major policies such as:
Amend and supplement a number of regulations related to Vietnamese nationality to facilitate cases where the biological father or biological mother or grandparents or grandparents are Vietnamese citizens; investors, scientists, foreign experts... are granted Vietnamese nationality.
Amend and supplement a number of regulations related to the return of Vietnamese nationality to facilitate the return of Vietnamese nationality to cases that have lost their Vietnamese nationality.
Accordingly, all cases of loss of Vietnamese nationality with an application can be considered for troation to Vietnamese nationality.
Minister Nguyen Hai Ninh also said that the draft law adds the condition "must have one nationality, Vietnamese nationality and must reside permanently in Vietnam" when Vietnamese citizens also have foreign nationality to participate in elected bodies, agencies of the political system and perform military and police service.
This regulation aims to ensure political security and national interests.
In addition, to create flexibility in recruiting specific cases with outstanding abilities to participate in state civil service, the draft Law stipulates "special cases prescribed by the Government".
Presenting the Report on the review of the draft Law, Chairman of the Law and Justice Committee Hoang Thanh Tung emphasized that the provisions in the draft Law will be an important legal basis for considering and deciding to allow overseas Vietnamese to become citizens, return to Vietnamese nationality, and enjoy the rights of Vietnamese citizens.
Approving the amendment and supplementation of Clause 1, Article 23 of the Law on Vietnamese nationality on cases of returning to Vietnamese nationality, Chairman of the Committee for Culture and Society Nguyen Dac Vinh said that this regulation both meets the desire to return to Vietnamese nationality of many Vietnamese people living abroad, and at the same time, creates conditions for them to continue living and working stably abroad.
This is a very correct, very timely and humane amendment - Chairman of the Committee Nguyen Dac Vinh emphasized.
Commenting at the meeting, Permanent Vice Chairwoman of the Committee for Petition and Supervision Le Thi Nga agreed with the draft Law adding a provision that "must be a person with only one nationality as a Vietnamese nationality" for "canditor, elected, approved, appointed, holding positions and titles according to the term; recruited, appointed to positions, positions and titles in state agencies and socio-political organizations at the central and local levels; participating in the armed forces of the Socialist Republic of Vietnam".
Concluding on this content, Vice Chairman of the National Assembly Nguyen Khac Dinh suggested that the Government should continue to study and clearly demonstrate in the Submission and Draft Law on institutionalizing special mechanisms for naturalization according to Resolution No. 57-NQ/TW of the Politburo.
Regarding the condition of being naturalized as a Vietnamese citizen but still holding foreign nationality, the Vice Chairman of the National Assembly basically agreed with the plan submitted by the Government, but suggested that it is necessary to study and supplement a number of cases proposed by the examining agency.
The Government also needs to review and clearly show that the case of a person applying for Vietnamese citizenship must have both a Mr. and a Ms. being a Vietnamese citizen or only need him or her to be a Vietnamese citizen.
