Ho Chi Minh City currently has about 5,562 non-professional workers at the commune level, but the time to stop using this force has not yet been clearly defined.

On June 20, the Ho Chi Minh City People's Committee sent a document to the Ministry of Home Affairs regarding the problem in determining the end time for using part-time workers at the commune level when implementing the 2-level local government organization model.

According to the Ho Chi Minh City People's Committee, the implementation of the 2-level local government organization model is being implemented on the basis of the direction of the Politburo and the Secretariat, including content related to the termination of the use of non-professional workers at the commune level.

In Official Dispatch No. 03-CV/BCD dated April 15, 2025 of the Steering Committee for the arrangement of administrative units at all levels and the development of a model of organizing local government at 2 levels, it clearly stated the orientation of organizing the apparatus, cadres, civil servants, and public employees, which stipulates: "Ans end the use of non-professional workers at the commune level from August 1, 2025".

However, on June 6, 2025, the Politburo and the Secretariat issued Conclusion No. 163-KL/TW on implementing a number of contents and tasks when reorganizing the apparatus and administrative units according to the resolutions and conclusions of the Central Committee, the Politburo and the Secretariat. This conclusion stated: "Research a roadmap to extend the use of part-time workers in accordance with the time of rearranging villages and residential groups (before May 31, 2026)".

Along with that, on June 15, 2025, the Government issued Decree No. 154/2025/ND-CP regulating staff streamlining. Article 9 of the Decree stipulates: "Unprofessional workers at the commune level will retire immediately from the implementation of the 2-level local government model according to the provisions of the Law on Organization of Local Government". Article 10 also stipulates: "Unprofessional workers in villages and residential groups who are redundant due to arranged leave immediately upon receipt of a decision on arrangement by the competent authority".

Through reviewing the Law on Organization of Local Government and the Resolution amending and supplementing a number of articles of the Constitution (approved by the National Assembly on June 16, 2025, effective from July 1, 2025), the Ho Chi Minh City People's Committee believes that if part-time workers at the commune level retire from the time the 2-level local government model takes effect (ie July 1, 2025), the settlement of regimes and policies will be applied according to Article 9 of Decree 154/2025/ND-CP of the Government.

In order to ensure the settlement of policies and regimes for non-professional workers at the commune level and agree on the time frame for terminating the use of this force, the Ho Chi Minh City People's Committee recommends that the Ministry of Home Affairs soon provide specific instructions.

That is, it is necessary to clearly determine the date of end of using non-professional workers as: July 1, 2025 (the effective date of the Law on Organization of Local Government, based on Article 9 of Decree 154/2025/ND-CP of the Government); or August 1, 2025 (according to Official Dispatch No. 03/CV-BCD of the Steering Committee); or extended to May 31, 2026 (according to Conclusion No. 163-KL/TW of the Politburo and the Secretariat).

Currently, Ho Chi Minh City has about 5,562 non-professional workers at the commune level.
