This content is stated in Decree No. 299/2026/ND-CP dated July 28, 2026 of the Government regulating the organization of public non-business units.
The Decree stipulates that for public non-business units that self-ensure recurrent expenditures and investment expenditures, and public non-business units that self-ensure recurrent expenditures: The number of deputy heads is implemented according to the establishment project (in case of new establishment) or the autonomy project of the unit that has been approved by competent authorities;
For public non-business units that partially ensure regular expenditures, public non-business units guaranteed by the state budget for regular expenditures: The number of deputy heads of units under the organizational structure of the ministry is arranged on average no more than 3 people per unit.
For departments under public non-business units that self-ensure regular expenditures and investment expenditures, public non-business units that self-ensure regular expenditures: Number of deputy heads implemented according to the establishment project (in case of new establishment) or the autonomy project of the unit that has been approved by competent authorities.
For departments under public non-business units that partially ensure regular expenditures, public non-business units that ensure regular expenditures by the state budget: Having a number of assigned employees from 7 to 9 people, 1 Deputy Head of Department is arranged; having a number of assigned employees from 10 people or more, no more than 2 Deputy Heads of Department are arranged.
Public service units are classified according to the following criteria:
- Legal status of public non-business units as prescribed;
- Providing public career services by industry and field, including: education and training; health; culture, sports and tourism; science and technology; economic careers and other careers (agriculture and environment; finance; construction; industry and trade; internal affairs; justice and other fields); providing multi-industry and multi-field public career services;
- Providing public service services according to the nature of tasks, including: Public service services serving society, public service services supporting the implementation of state management tasks;
- Financial autonomy level according to the provisions of law on the financial autonomy mechanism of public non-business units.
Ranking criteria for public non-business units include:
- Group of criteria on organizational scale, workload;
- Group of criteria on structure, labor level and management complexity;
- Group of criteria on physical infrastructure, level of modernization (assets, equipment, working means) and level of digitization (application of information technology in management, provision of online public services and data infrastructure);
- Group of criteria on operational efficiency (assessing the quality of public service services, periodically assessing people's satisfaction, applying digital technology for people to directly assess the quality, efficiency, and level of satisfaction with public service services) and financial management efficiency, level of financial autonomy;
- Other base groups according to the specific characteristics of each industry and field (if any).
This Decree takes effect from July 28, 2026.
