The Government Office has just issued Notice No. 149/TB-VPCP dated March 23, 2026, concluding the Standing Committee of the Government on the Decree detailing the handling of BOT traffic project problems.
The notice stated that at the meeting of the Standing Committee of the Government on the Decree detailing the handling of BOT traffic project problems, the Standing Committee of the Government agreed in principle to develop a policy on compensation and contract termination ensuring the principle of "harmonious benefits, shared risks" and the Decree only stipulates the principle and detailed data on compensation and contract termination based on the results of negotiations and consensus of relevant parties (investors, project enterprises and credit institutions); ensuring no loss or waste of assets or state budget.
The Standing Committee of the Government assigned the State Bank of Vietnam to consider specific guidance on increasing and decreasing, and supporting loan interest for credit institutions according to its authority and according to current legal documents.
At the same time, assigning the Ministry of Construction to fully absorb the opinions of the Deputy Prime Ministers, ministries and sectors at the meeting, urgently complete the submission and draft Decree, and submit it to the Government on March 23, 2026.
In which, it is necessary to pay attention to clarifying the following contents: Information on the results of implementing the conclusions of state inspection and audit agencies at projects; the efficiency of exploitation and use of projects expected to terminate contracts; affirming that the arising problems of projects that need to be handled are within the subjects of Directive No. 27-CT/TW dated December 25, 2023 of the Politburo and belong to the subjects according to the provisions of the PPP Law.
On a political, legal and practical basis, improve compensation policies, terminate contracts according to the principle of "harmonious benefits, shared risks", thoroughly handle obstacles of BOT projects to improve the investment environment and must ensure payment value according to the settlement value and audit.
The State Audit Office shall conduct audits before payment and termination of contracts to prevent loss of assets and state budget.
The Standing Committee of the Government assigned Deputy Prime Minister Tran Hong Ha to direct the Ministry of Construction to complete the dossier and assign the Government Office to get opinions from Government members on compensation policies and contract termination before the deadline specified in the draft Decree; consider signing and promulgating the Decree in March 2026.
