From May 2026, the 2025 Law on Judicial Examination passed by the National Assembly will take effect.
The Law stipulates the personnel of judicial examination (GĐTP), GĐTP organizations; GĐTP order and procedures; GĐTP costs; regimes and policies in GĐTP activities; state management of GĐTP; responsibilities of procedural agencies, organizations, and individuals related to GĐTP activities.
Article 24 of the Law clearly stipulates the rights and obligations of GĐTPs in GĐTP activities.
In which, the GĐTP has rights such as requesting the petitioner, requesting GĐTP to provide complete petition dossiers, and requesting appraisal.
To be able to choose the necessary and appropriate method to conduct appraisal according to the content, field or specialty to be appraised.
Use the results of experiments, tests, professional conclusions or appraisal conclusions made by other organizations or individuals to serve the appraisal; independently issue appraisal conclusions;
It is requested that the person requesting GĐTP or the competent authority take measures in accordance with the law to protect themselves and their relatives when life, health, honor, dignity, and property are threatened due to participating in the case or case.
Or refuse to perform GĐTP in some cases specified in this Law; be arranged in a suitable position when participating in proceedings at the court.
Being entitled to remuneration, GĐTP allowance, court participation costs and other necessary costs according to the provisions of law.
Be considered for exclusion, exemption, and reduction of liability according to the provisions of relevant laws and of competent authorities when they have performed expertise in accordance with regulations on procedures, procedures, judicial expertise process, professional standards in expertise activities, impartial, objective, and non-profit.
In case of fraudulent conclusions or refusal of assessment conclusions without force majeure reasons or objective obstacles, criminal responsibility must be borne according to the provisions of the Penal Code.
The Law on GĐTP 2025 also stipulates that GĐTPs have obligations such as complying with GĐTP procedures and professional standards in appraisal activities when performing GĐTP.
Performing appraisal according to the content, field or specialty to be appraised; performing and returning appraisal conclusions on time as required; preparing appraisal dossiers.
Preserve the appraised object, documents, and related specimens that have been received and return them to the competent authority according to regulations; do not notify others of the appraisal results, unless agreed in writing by the appraiser or appraiser requester.
Must be personally responsible for the appraisal conclusions issued by themselves; compensate for damages when performing GPs according to the provisions of law.
