The 2025 Law on Judicial Examination passed by the National Assembly takes effect from May 2026.
The Law consists of 6 chapters, 45 articles regulating judicial appraisers, judicial appraisal organizations; procedures and processes for judicial appraisal; costs of judicial appraisal; regimes and policies in judicial appraisal activities; state management of judicial appraisal; responsibilities of procedural agencies, organizations, and individuals related to judicial appraisal activities.
Regarding the State's policy on judicial expertise activities, this Law stipulates that the State invests and develops a system of public judicial expertise organizations in areas with large and regular expertise needs to meet the requirements of procedural activities.
Have preferential policies, creating favorable conditions associated with strict control of appraisal quality for non-public judicial appraisal organizations, case-based judicial appraisal organizations or other units, organizations, and individuals when participating in judicial appraisal activities.
The State has policies to prioritize training and professional development for forensic experts; promote the application of science and technology, digital transformation; build a database on forensic expertise.
Regarding the responsibility of state management in judicial expertise activities, the Government uniformly manages state management of judicial expertise nationwide; The Ministry of Justice is the focal agency, helping the Government uniformly manage state management of judicial expertise.
Ministries and ministerial-level agencies are responsible for assisting the Government in state management of forensic examination in specialized fields under their management authority; coordinating with the Ministry of Justice in unifying state management of forensic examination.
The Supreme People's Procuracy shall implement the management contents for public forensic examination organizations under its organization; summarize the organization and activities of forensic examination under its management authority and send reports to the Ministry of Justice for annual reporting to the Government.
The People's Committees of provinces and cities are responsible for state management of judicial expertise in the locality according to regulations.
