On the afternoon of November 25, continuing the 8th Session, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Advertising.

Delegate Tran Thi Thu Hang (Dak Nong Delegation) said that the new draft law only mentions outdoor advertising planning. The delegate suggested studying the synchronous planning of billboard locations in an area to ensure urban aesthetics and fairness among businesses.

According to the delegate, currently the arrangement of advertising signs is still based on the preferences, thinking, and competition of each business household and individual, but there are no specific sanctions.

The delegate also said that advertising currently stands out with two trends: advertising on television and the internet. Over the years, television has become an indispensable means of information in every family, becoming a two-way interactive form with a very wide range of activities and the ability to gather a large audience.

Television channels are constantly improving the quality of their services and organizing game shows that attract audiences of all ages. However, delegates said that the concept in the draft law has ignored the scope of television.

Regarding the form of advertising on the internet, advertising through social networks such as Facebook, Zalo, YouTube... is currently developing very strongly in our country. That means advertising on the internet has high interaction, creating opportunities for advertisers to accurately target their customers, advertising according to the interests and tastes of the people.

The delegate said that social networks are one of the applications used on the internet platform. Therefore, using the concept of a person transmitting advertising products that operate on the internet will be more general than social networks.

According to the delegate, the draft law stipulates that the person transmitting the advertising product is obliged to provide documents related to the advertising content, revenue, product name, and quantity.

However, it is feasible to require the advertiser to provide the quantity of each product generated from the periodic advertising activity since this is the advertiser's responsibility.

In case the advertiser is a business that does not provide this information, the person transmitting the advertising product cannot grasp it.

The delegate also proposed to review the regulation that the person transmitting the advertising product is jointly responsible in case the advertising content does not meet the requirements prescribed in this law.

Delegate Nguyen Minh Tam (Quang Binh) said that currently, the use of electronic media connected to the Internet is used by all ages, including children. Meanwhile, advertising on electronic media is an automatic activity, not depending on the user's choice.

On the other hand, online advertising activities are very diverse, including sensitive content and even elements that are not suitable for certain audiences and ages.

However, the new draft only stipulates: “For advertisements not in fixed areas, a feature must be designed to turn off the advertisement within no more than 6 seconds from the start of the advertisement and no more than 2 consecutive advertisements; allowing the rejection of the advertisement or reporting of inappropriate advertisement content”.

Delegate Nguyen Minh Tam said that within 6 seconds, internet users can recognize and access all advertising content, including unwanted advertising content.

Therefore, the delegate suggested that the Drafting Committee of the draft law study regulations in the direction of designing features with the choice of advertising or not advertising.
