The Ministry of Home Affairs has just issued a document responding to the Department of Home Affairs of Dien Bien province regarding the ranking of civil servant ranks according to job positions, as stipulated in Decree 361/2025/ND-CP of the Government.
In which, the Ministry has specific guidance on ranking senior specialist ranks or equivalents for Deputy Directors of Departments and equivalents.
Clause 3, Article 9 of Decree No. 361/2025/ND-CP stipulates the ranking of civil servants according to job positions at specialized agencies under the province: Ranking as senior specialists and equivalents for heads and deputy heads of specialized agencies under the province;
Ranking principal and equivalent specialist ranks for civil servants of specialized agencies under the province;
Ranking specialist and equivalent ranks for civil servants assigned to specialist and equivalent job positions;
Classifying cadres and equivalents for civil servants assigned to cadre and equivalent positions.
At the same time, point b, clause 1, Article 8 of Decree No. 361/2025/ND-CP stipulates the proportion of civil servants arranged according to job positions ranked as senior specialists and equivalent for leadership and management positions that are deputy heads of specialized agencies under the province: The proportion does not exceed 50% of the total number of deputy heads of all specialized agencies under the province according to the regulations of competent authorities.
Therefore, the ranking of senior and equivalent specialist ranks only applies to heads and deputy heads of specialized agencies under the province; for civil servants of specialized agencies under the province who are ranked as principal and equivalent specialists, specialists and equivalents, officials and equivalents according to the assigned job position.
For Deputy Directors of Departments, in case they meet the standards and conditions of the rank of senior specialist, and at the same time ensure the rank of senior specialist for deputy heads of specialized agencies according to the provisions of point b, clause 1, Article 8 of Decree No. 361/2025/ND-CP, they are ranked as senior specialists and equivalents.
