On the morning of November 29, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Supervisory Activities of the National Assembly and People's Councils (PCs).
Delegate Tran Van Tien (Vinh Phuc Delegation) said that the draft law stipulates that the criteria for selecting the National Assembly's supervision topics are topical issues, related to state management, law making and enforcement, deciding on important issues of the country, and synthesizing many fields and other issues.
The Standing Committee of the National Assembly shall specify the criteria and procedures for selecting the National Assembly's supervisory topics.
Delegates proposed that the criteria for selecting the National Assembly's supervision topics should be topical issues and issues of social concern, linked to state management, law making and enforcement, decisions on important national issues, and comprehensive in many fields and other issues.
In addition, the draft law also stipulates that the results of monitoring legal documents must be sent to the Secretary General of the National Assembly for synthesis and reporting to the National Assembly Standing Committee.
If necessary, the Nationalities Council and the National Assembly Committees shall recommend that the National Assembly Standing Committee issue a resolution on supervising the promulgation of legal documents. Delegates requested clarification on what constitutes a “necessary case” to ensure clarity and consistency in implementation.
The draft law also stipulates that the monitoring delegation is headed by the Chairman or Vice Chairman of the People's Council, with other members including members of the Standing Committee of the People's Council, representatives of the People's Council's Committee and a number of People's Council delegates.
Representatives of the Vietnam Fatherland Front Committee at the same level, member organizations of the Front, and experts may be invited to join the Supervisory Delegation. Regarding this content, delegates suggested reviewing regulations on expert criteria to ensure compliance with regulations and quality.
In addition, delegates suggested that it is necessary to clearly stipulate how to handle cases in districts, cities, towns, and wards where the urban government only includes the People's Committee without the People's Council.
Regarding viewpoints and approaches, delegate Nguyen Thi Mai Hoa (Dong Thap delegation) said that the 15th National Assembly determined that supervision is the central and key step to innovate the activities of the National Assembly.
The delegate emphasized that the spirit of supervision is not to find errors or limitations, but to accompany, create development and provide input data for the National Assembly in deciding important issues of the country.
Delegates gave an example of monitoring the implementation of three national target programs for the 2021-2025 period.
Regarding methodology, according to delegates, the draft law on amendments and supplements must implement requirements related to the renovation period, and at the same time must consider the close connection with other relevant laws such as: Law on Organization of the National Assembly, Law on Organization of the Government, Law on Organization of Local Government... in the context of current apparatus restructuring.
Emphasizing the very wide scope of amendments to the draft law, delegates proposed to consider and amend the name of the draft law to "Law on Supervisory Activities of the National Assembly and People's Councils (amended)" instead of "Law on amending and supplementing a number of articles of the Law on Supervisory Activities of the National Assembly and People's Councils" as currently.
At the same time, it is recommended that the drafting agency reconsider the timing of passing the draft Law to ensure consistency and synchronization in the legal system.
