The Ministry of Home Affairs has issued Document 4177 to central, provincial and municipal agencies to guide the implementation of Decree 178/2024 and Decree 67/2025 of the Government.
The official dispatch of the Ministry of Home Affairs also clearly states a number of orientations in resolving policies and regimes.
Accordingly, in the process of arranging administrative units and organizing local governments at 2 levels, if cadres, civil servants and public employees wish to quit their jobs immediately, local Party committees and authorities will base on the regulations to consider and decide on immediate resignation and will immediately enjoy the policies and regimes according to Decree 178/2024, amended and supplemented in Decree 67/2025.
The bases for consideration and decision are the resolutions of the National Assembly, the National Assembly Standing Committee on the arrangement of provincial and commune-level administrative units and the overall project to arrange specialized agencies, administrative agencies, and public service units when implementing the 2-level local government model.
For agencies, organizations, and units that are dissolved or terminated, if cadres, civil servants, public employees, and workers wish to quit their jobs, the head of the agency, organization, or unit must, before dissolving or terminating their operations, work with the Party Committee and the authorities at the same level to consider and decide according to their authority or report to the competent authority for consideration and decision, and do not have to conduct a team quality assessment.
In the process of reorganizing the apparatus, if the number of positions present is lower than the staffing framework prescribed by the competent authority, resignation will only be considered and resolved for cases that do not meet the requirements of the task or do not meet the standards for cadres and civil servants (new commune level).
After stabilizing the organizational arrangement, recruitment will be carried out according to the decentralization of management of cadres, civil servants, and public employees in conjunction with restructuring and improving the quality of the team.
