Continuing the 9th Session, on May 17, Minister of Finance Nguyen Van Thang presented the draft PPP Law (amended) to the National Assembly.
In particular, regarding the mechanisms, incentives, and guarantees of the State, the PPP Law (amended) has added content stipulating the mechanism for handling difficulties in reducing revenue for BOT projects implemented before the PPP Law takes effect, in order to remove the difficulties that have lasted for many years of this group of projects.
According to the drafting agency, the regulations on mechanisms for applying types of contracts, preferential policies, investment guarantees, and risk sharing in the current PPP Law are not suitable to encourage science and technology enterprises to participate in investment.
Limiting the application of contracts for direct fee collection from users for renovation, upgrading and expansion works also leads to difficulties in mobilizing private resources to participate in investing in works and infrastructure serving scientific and technological research invested by the State.
For PPP projects in other fields that have been implemented many years before the PPP Law took effect, many problems have arisen.
As the BOT project, according to the drafting agency and report of the Ministry of Construction shows that this ministry has cooperated with the State Bank of Vietnam and localities to review the overall problems of BOT Traffic project throughout the country, build a list of 11 quantitative projects (Ministry of Construction 8 projects, localities 3 projects).
At the same time, the Ministry of Construction has held negotiations with investors and credit banks to agree on solutions to resolve the problem (expected to allocate state capital to pay to terminate contracts for 6 projects, and supplement state support capital to continue implementing contracts for 5 projects).

According to Minister Nguyen Van Thang, implementing the guidance of the Government leaders, the Ministry of Finance has exchanged and agreed with the Ministry of Construction to add to the PPP Law project stipulating the mechanism of handling problems to reduce revenue for BOT projects with contracts signed before the time of 1.1.2021 (PPP Law date effective - PV) but the contract has not yet applied the actual sharing mechanism to reduce the revenue and revenue due to the contract of revenue and revenue due to the contract of revenue and revenue due to the contract of revenue and revenue due to the error of the boundary of the boundary of the boundary of the bugs and revenue of the boundary of the boundary of the contract of revenue and revenue due to errors of the bugs and revenue of the bend of the contract of revenue and revenue of the contract of the contract of the contract of revenue and revenue. Regarding the above content, the National Assembly's Economic and Financial Committee (the agency reviewing the draft Law) proposed that the Government review and ensure the political basis and strictly stipulate in the draft law.
The KTTC Committee recommends applying only to projects for which the causes of difficulties and obstacles are responsible of the State, meeting strict and specific conditions, to ensure clarity, consistency, transparency and avoid policy loopholes.
The PPP Law (amended) will be discussed by the National Assembly in groups this afternoon (May 17).
