The People's Committee of Long Thanh district, Dong Nai province has just issued a decision to ban Duy Tai Construction Mechanical Company Limited from participating in bidding activities for 3 years (Duy Tai company). The decision takes effect from March 11, 2025.
It is known that Duy Tai Company is headquartered at No. 36, Street 768 B, Group 13, Quarter 4, Trang Dai Ward, Bien Hoa City, Dong Nai Province.
According to the decision, for a period of 3 years, this contractor is not allowed to participate in bidding activities for investment and business projects, procurement estimates using budget capital invested or invited by agencies, departments, branches, People's Committees of communes and towns in Long Thanh district.
Duy Tai Company was banned from bidding due to fraud as prescribed in Clause 4, Article 16 of the 2023 Bidding Law when participating in bidding for package No. 21 (commodities) of electrical equipment, transformer stations and wastewater treatment equipment of the resettlement area infrastructure project in Long Duc commune, Long Thanh district.
The People's Committee of Duy Xuyen district, Quang Nam province also decided to terminate the contract and prohibit participation in bidding activities with Minh Tien Construction Development Joint Stock Company (Minh Tien Company) headquartered at 39 Tran Dai Nghia, Tan Thanh ward, Tam Ky city, Quang Nam province.
Minh Tien Company violated the contract as prescribed in Point b, Clause 16, Article 16 of the construction contract No. 155/HDTC/2021 dated October 21, 2021. The bidding period is until March 9, 2028.
According to Duy Xuyen District People's Committee, based on the penalty against Minh Tien Company, because during the contract implementation period, the contractor was no longer capable of clearly expressing his intention to continue to fulfill its obligations under the contract. The contractor violated the contract and was not the fault of the investor.
