From the beginning of July 2026, the Law on Ejection of Temporary Detention, Imprisonment and Prohibition of Leaving the Place of Official Residence takes effect.
This Law stipulates the principles, order, and procedures for implementing preventive measures in criminal proceedings, including temporary detention, imprisonment, prohibition from leaving the place of residence; organization, tasks, powers, and models of agencies managing and enforcing temporary detention, imprisonment, and prohibition from leaving the place of residence.
At the same time, stipulating the rights and obligations of people being temporarily detained, people being temporarily detained, people being prohibited from leaving their place of residence; responsibilities of relevant agencies, organizations, and individuals in implementing measures to prevent temporary detention, temporary detention, and prohibition from leaving their place of residence.
The law also clearly stipulates prohibited acts:
Strictly prohibit torture, persecution, and torture; forms of cruel, inhumane, humiliating treatment and punishment or any other forms of infringing upon the legitimate rights and interests of detainees, inmates, and people prohibited from leaving their place of residence;
Failure to comply with or improperly or incompletely implement orders and decisions of agencies and competent persons on temporary detention, temporary custody, release, prohibition from leaving the place of residence;
Illegally detaining people; illegally releasing people who are temporarily detained, people who are temporarily detained; violating regulations in managing, guarding, escorting people who are temporarily detained, people who are temporarily detained; letting people who are prohibited from leaving their place of residence leave their place of residence illegally;
Obstructing detainees and people in temporary detention from exercising the right to visit relatives, the right to defense, legal assistance, consular contact, complaints, denunciations, human rights, and other rights and obligations of citizens in accordance with the provisions of this Law and other relevant laws;
Destroying the detention facility, destroying or intentionally damaging the property of the detention facility; organizing to escape or escape from the detention place; organizing to escape or escape while being escorted or being prohibited from leaving the place of residence; ejecting people being temporarily detained, people being temporarily detained;
Failure to comply with the regulations of the detention facility, the detention management regime or decisions and requests of agencies and competent persons managing and enforcing temporary detention, temporary detention, prohibition from leaving the place of residence;
Implementing or organizing, inciting, instigating, luring, seducing, assisting, concealing, forcing others to violate the law on execution of temporary detention, temporary imprisonment, prohibition from leaving the place of residence; retaliating, infringing upon the life, health, honor, dignity, property of others in execution of temporary detention, temporary imprisonment, prohibition from leaving the place of residence...
