The above content is stated in Article 30 of the Law on Residence, which regulates notification of stay.
According to regulations, when someone stays overnight, family members, representatives of medical facilities, tourist accommodation establishments, owners or people assigned to manage vehicles, and other accommodation establishments are responsible for notifying the residence registration agency of their stay.
In case the person arrives to stay at the residence of an individual or household, but the individual or member of the household is not present at that residence, the person arriving to stay is responsible for notifying the residence registration agency.
The content of the notification of stay includes: full name, date, month, year of birth, personal identification number or passport number of the staying person; reason for stay; length of stay; address of stay.
The notification of stay is made before 11 pm on the day of starting stay; in case the person arrives to stay after 11 pm, the notification of stay is made before 8 am the next day.
Citizens declare temporary absence to the residence registration agency where they reside through the National Public Service Portal or the national identification application.
The residence registration agency receives the content of the temporary absence declaration, checks the content of the declaration and exchanges with the competent authority to supervise, manage, and educate that person.
Within 1 working day from the date of receiving the request for temporary departure declaration, the residence registration agency shall issue a temporary departure declaration form to the citizen; in complicated cases, the resolution time may be extended but not exceeding 2 working days.
According to Decree No. 347/2026/ND-CP of the Government, from September 15, accommodation business establishments, collective houses, medical facilities, tourist accommodation establishments, accommodation in industrial parks and establishments with accommodation functions that do not notify accommodation will be fined according to the number of people.
In which, a fine of 2-4 million VND if not notifying the stay of 1-3 people; 4-8 million VND if from 4-8 people; and 8-12 million VND if from 9 people or more.
