The Government has just issued Decree No. 354/2026/ND-CP dated September 11, 2026, amending and supplementing a number of articles of Decree No. 33/2025/ND-CP dated February 25, 2025, stipulating the functions, tasks, powers and organizational structure of the Ministry of Construction.
Regarding planning and architecture, the Ministry of Construction is responsible for organizing the development and appraisal of the overall urban and rural system plan; participating in the appraisal of plans in accordance with the law on planning.
In construction investment activities, the Ministry of Construction uniformly manages the state for the issuance and revocation of professional certificates; manages the issuance of professional certificate codes.
For the field of urban development, Decree No. 354/2026/ND-CP supplements the tasks of the Ministry of Construction in organizing appraisal and issuing decisions recognizing type I urban areas.
Regarding security and traffic safety, the Ministry of Construction is responsible for issuing the Vietnam Civil Aviation Safety Program according to its authority; detailing the development, evaluation, and approval of maritime security plans, seaport security plans and water area and waterway security plans; regulating the issuance of certificates related to maritime security, seaport security; presiding over or coordinating the inspection and provision of information on civil aviation and maritime security in accordance with the law.
Organize investigations into serious incidents, aircraft accidents, and maritime accidents according to their authority and legal regulations.
Decree No. 354/2026/ND-CP amends the organizational structure of the Ministry of Construction. Accordingly, the Ministry of Construction has 22 directly affiliated units (a reduction of 1 unit compared to the old regulation of Inspection), including:
(1) Office;
(2) Department of International Cooperation;
(3) Legal Department;
(4) Department of Planning - Finance;
(5) Department of Organization and Personnel;
(6) Department of Planning - Architecture;
(7) Department of Transport and Traffic Safety;
(8) Department of Science and Technology, Environment and Building Materials;
(9) Vietnam Aviation Administration;
(10) Vietnam Road Administration;
(11) Vietnam Maritime and Waterway Administration;
(12) Vietnam Railways Authority;
(13) Vietnam Register;
(14) Department of Economics - Construction Investment Management;
(15) State Authority for Construction Quality Inspection;
(16) Department of Urban Development;
(17) Department of Housing and Real Estate Market Management;
(18) Department of Construction Infrastructure;
(19) Information Technology Center;
(20) Construction Newspaper;
(21) Construction Magazine;
(22) Strategic Academy, fostering construction cadres.
Organizations specified from (1) to (18) are organizations assisting the Minister in performing state management functions; organizations specified from (19) to (22) are public non-business units serving the state management functions of ministries.
The Civil Aviation Authority of Vietnam is a type 1 Authority. The Civil Aviation Authority of Vietnam, the Vietnam Road Administration, and the Vietnam Maritime and Waterway Administration are allowed to use national emblem seals.
This Decree takes effect from September 15, 2026.
